Convocatoria Desagregación Efectiva de la Red Local: Novena Sesión.

IFT-1 Licitación de dos cadenas de televisión radiodifundida digital



   

Con el Decreto de Reforma Constitucional en Telecomunicaciones se ha determinado que la radiodifusión es un servicio público de interés general y que corresponde al Instituto Federal de Telecomunicaciones (IFT) el otorgamiento de Concesiones del espectro radioeléctrico en dicha materia y que éstas, cuando su uso es comercial, serán otorgadas mediante licitación pública.

En ese tenor, la Constitución ha mandatado al IFT publicar las Bases y Convocatorias para licitar nuevas concesiones de frecuencias de televisión radiodifundida que deberán ser agrupadas a efecto de formar por lo menos dos nuevas cadenas de televisión con cobertura nacional.

From the billing month of April, the Telmex and Telnor bill format will contain clearer and detailed information on services and / or goods that users will pay

• For the first time, unique concessions for commercial use are going to be granted; the Plenary determine 12 applications under this figure, which may provide all kinds of public telecommunications services and broadcasting

• They decided to declare the loss of assets for the benefit of the nation, derived from the assurance of equipment for the use of frequencies for leased public transport without permission in three locations

• The Commissioner President, Gabriel Contreras Saldívar, presented his first state Report that holds the management of human, financial, material and technological IFT resources

 

In regular meeting yesterday, the Plenary of the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) approved the format of the telephone bill by which Teléfonos de Mexico (Telmex) and Teléfonos del Noroeste (Telnor), as members of the Preponderant Economic Agent (PEA) in the telecommunications sector, will bill telecommunications services, and any other goods and / or different services from telecommunications provided to its customers, so the users can have clear and transparent information on what they will pay.

According to the Forty-seventh measure of the Preponderance Measures imposed by the IFT at PEA in the telecommunications sector, that it must notify to all the subscribers, by printed notice or electronic invoice, by the Institute authorized formats, the amount the user would have to pay if he/she decides to conclude, at the billing time, his/her contractual relationship, derived from the sale of goods or services other than telecommunications.

Thus, the sale of goods or services other than telecommunications, may not become a cause for which the subscriber cannot cancel the telecommunications services contracted.

Similarly, the Forty-eighth extent of these measures provides that PEA must disaggregate the concepts collected or billed to the subscriber, distinguishing the concepts associated with telecommunications services provided by that agent, of any other good or service that is not telecommunications or any service provided by another company hired by the subscriber and billed by the Preponderant Economic Agent. The format of the bill must allow the independent payment of telecommunication services provided by the PEA and any other goods or services included in the bill.

Even when there are debts associated with goods or services other than telecommunications, or any other service provided by another company and billed by the Preponderant Economic Agent, it may not interrupt the provision of services, provided that the subscriber is currently up to date with the payments for the rendered telecommunications services.

Thus, from the billing month of April, the bill format Telmex and Telnor will contain:

a) A notice indicating the amount the user would have to pay if he/she decides to terminate at the time of billing, the contractual relationship, derived from the sale of goods or services other than telecommunications.

b) Clearly distinguish the concepts associated with rendered telecommunications services, any other good or service that is not telecommunications or any service provided by another company hired by the subscriber and billed by these companies.

c) Allow the independent payment for telecommunications services provided and any other goods or services included in the bill.

Likewise, users may find that due to the elimination of national long distance, all calls originating within the country are considered local service calls.

Moreover, the Plenary of the Institute decided to award 12 concession titles for commercial use, which can be possible to provide all kinds of public telecommunications and broadcasting. It is the first time the Institute approves grants under this figure referred to in the Federal Telecommunications and Broadcasting Law. Six of these new concessions relate to individuals and six to juridical persons.

It was also decided to declare the loss of assets for the benefit of the nation, derived from the assurance of equipment for the use of frequencies for leased public transport without license, the permit, authorization or respective allocation in three locations in Nuevo León: 158.8625 MHz, in Apodaca, 463 525 MHz, in San Nicolás de los Garza; and 156.300 MHz in San Pedro Garza García. In the first two cases there were also economic sanctions.

In other matters, the Commissioner President of the Institute, Gabriel Contreras Saldívar, presented his first status report that holds the management of human, financial, material and technological IFT resources, pursuant to the provisions of Articles 20, section III of the Federal Telecommunications and Broadcasting Law and 14 Section I of the Organic Statute.

The report presents the main actions, measures, standards and strategies adopted by the Administration Unit of the Institute, from the administrative transition in 2013 with the disappearance of Cofetel and the creation of IFT and until the first two months of 2015. This represents an exercise transparency and accountability in the use of public resources entrusted to the Institute to fulfill its responsibilities and provides elements and as appropriate for anyone interested in understanding and assessing institutional performance information. The report will be presented annually in the month of March.

Attached to the document, the Institute's financial statements are presented at December 31, 2014 with the report of Auditores Independientes Mancera, S.C. integral part of Ernst & Young Global. It should be noted that the Institute auto-imposed the obligation to audit their financial statements at the end of each fiscal year by an independent accountant, before submission to the Secretariat of Finance and Public Credit, in order to submit their audited figures.

The IFT Plenary puts an end to the proceedings brought by Axtel and Avantel to resolve interconnection disputes with Telcel and Grupo Iusacell

 

They are terminated interconnection disputes between Axtel and Avantel that began in 2008 to meet the terms, conditions and rates for 2008-2011 with Telcel and 2008-2010 with Iusacell

• Axtel, Avantel, Telcel and Grupo Iusacell reported to IFT that they have signed amendment agreements in which they agree to the terms, conditions and rates for different years

• The requests submitted by Axtel to determine the weighted average rate in Telcel, and Grupo Iusacell mobile networks for the period 2005-2007, under Axtel withdrawal concerning proceedings were terminated

 

In extraordinary session, the Plenary of the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) puts an end to the proceedings initiated in 2008 to resolve interconnection conditions not agreed among those concessionaires for 2008-2011 and ordered the closure of the respective records by virtue of Agreements concluded by the parties setting forth the terms, conditions and rates for interconnection that were the subject of the following:

1. Axtel and Telcel for the modality "local calling party pays".

2. Avantel and Telcel for the modality "national calling party pays".

3. Avantel and Grupo Iusacell for the modality "national calling party pays".

4. Axtel and Avantel with Grupo Iusacell for the modality "local calling party pays".

The Plenary of the Institute also ended the administrative procedures related to the applications for determining the weighted average rate in mobile networks Telcel and Grupo Iusacell for the years 2005, 2006 and 2007 and ordered the closure of the respective files derivative of withdrawal by Axtel.

Meanwhile, the Regulatory Policy Unit ended the procedure of interconnection conditions not agreed between Axtel, Avantel and Telcel for the period 2012 to 2013 for both modalities.

In this way, several interconnection disputes that since 2005 those concessionaires had kept, are terminated, whereby the will of the parties is privileged in terms of interconnection agreements provided both the provisions of the repealed Federal Telecommunications Law and the Federal Telecommunications and Broadcasting Law.

Preliminary judgement of IFT investigating authority concludes that the economic interest group led by Grupo Televisa has substantial power on restricted TV market

 

In compliance with the provisions of Section V of Article 96 of the Federal Law of Economic Competition (Ley Federal de Competencia Económica, LFCE), the Investigating Authority issued the Preliminary Judgement regarding the existence of operators with significant power in the relevant market in the provision of the television and audio restricted service.

Also the research was conducted based on the mandate in Thirty Ninth Transitional Article of the Federal Telecommunications and Broadcasting Law.

Of the elements analyzed during the investigation period, it is concluded that the relevant market is for the provision of television services and restricted audio through any transmission technology with a local geographic dimension, taking as a geographical unit study the municipio[1] for the whole country, except for the Federal District, in which case a single geographic market was defined and which includes 16 boroughs that comprise it.

Similarly, it is concluded that the economic interest group where Grupo Televisa is part of, has substantial power in 2,124 relevant markets.

The economic agents evidencing an interest in the matter, may manifest what serves their interests and provide the evidence that would consider relevant to the Preliminary Opinion, within twenty working days following the publication in the Official Gazette of the Federation of Preliminary Opinion Relevant Data.

The IFT Economic Competence Unit will initiate a procedure as trial in which all parties with legal interest may offer evidence and arguments. This phase will conclude with the presentation of a draft resolution which, in turn, will be submitted for the consideration of the Plenary, so that, if appropriate, it can rule on the existence of substantial power on the basis of the Federal Economic Competition Law.

From that decision of the Plenary, corresponds to the Regulatory Policy Unit in contribution with Economic Competition Unit, to conduct the procedure in terms of the Federal Telecommunications and Broadcasting Law to issue the necessary measures to promote competition in these markets.

The Federal Telecommunication Institute delivers the certificates of participation to the interested in two national digital TV broadcasted networks bidding

 

• The Plenary of the Institute agreed the issuance of Certificates of Participation to Cadena Tres I, S.A. de C.V. and Grupo Radio Centro, S.A.B. de C.V.

• The opening of the envelopes with the coverage and cost proposals will be held next March 11th at the installations of the Institute.

• The Plenary also agreed to return of the bid bond to Centro de Información Nacional de Estudios Tepeyac, S.A. de C.V., for its withdrawal to continue participating in the bidding process.

 

On its III Ordinary Session of February 26th, 2015, the Federal Telecommunications Institute (IFT) agreed to issue the Certificates of Participation to Cadena Tres I, S.A. de C.V. and Grupo Radio Centro, S.A.B. de C.V., which allows them to achieve the quality of "Participants" in the public tender for the concession of the use, development and commercial exploitation of transmission channels for the provision of broadcast digital television public service, in order to form two national networks in the United Mexican States (Tender No. IFT-1).

After the analysis and evaluation of submissions by stakeholders in the tender, listed in the Annexes to Appendix A of the bases, as well as all the technical, economic, legal and on established economic competition, the Institute delivered today the respective Certificates of Participation to stakeholders who met all requirements as stipulated in Section 4.2.1.4 of the bases themselves.

The now Participants in the tender and advance to the third step of the "Opening and Qualification of Bids and Economic Coverage". The opening of the envelopes containing the proposed economic coverage and presenting those interested in participating in the tender since November 20th last year, will be held next March 11th in the presence of a notary public and social witness hired to Bid No. IFT-1. The ruling will be issued by the Plenary of the Institute not later than March 19th.

At the same meeting, the Plenary of the Institute also agreed to the return of the bid security to Centro de Información Nacional de Estudios Tepeyac, S.A. de C.V., for its withdrawal to continue to participate in the bidding process.

Thus concludes in a timely manner, a step in the bidding process for two new national digital broadcast television networks, in compliance with the mandate contained in the 2013 Constitutional Reform on Telecommunications.

• Correspond to started processes before and after the entry into force of the Federal Telecommunications and Broadcasting Law

 

The Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) solved this

Thursday in regular session, three interconnection disputes between companies NII Digital, S. de

R.L de C.V. and Pegaso PCS, S.A. de C.V. corresponding to different periods.

The Institute established that interconnection rates that these companies must pay on a reciprocal basis for termination switched services in mobile users under the "calling party pays" will be the following:

• From January 1st, 2013 to December 31st, 2013, $ 0.3144 pesos per interconnection minute.

• From January 1st to August 12th, 2014, $ 0.3199 pesos per interconnection minute. The same fee shall be covered by NII Digital to Pegaso PCS in termination switched services for mobile users in the form "calling party pays"; based on Twenty Transitory Article of the Decree of the Federal Telecommunications and Broadcasting Law, the same rate should be extended for the period from August 13th to December 31st, 2014.

• From February 26th to December 31st, 2015, $ 0.2505 pesos M.N. per interconnection minute, while for the period from January 1st to February 25th should be extended the rate set by the Institute for 2014.

In that resolution, the Plenary of the Institute determined that the interconnection rate that Pegaso PCS shall pay to NII Digital for termination of local services to fixed users, from February 26th to December 31st, 2015, will be $ 0.004179 pesos M.N. per interconnection minute, while for the period from January 1st to February 25th, it should be extended the rate that the parties had agreed for 2014.

In all cases, companies must calculate the consideration to be paid based on the actual duration of calls, unrounded minute.

Interconnection rates which the Institute solved for 2013 and 2014 were processed and vented under the Federal Telecommunications Law, since applications were filed during the term of the same, with the former Federal Telecommunications Commission (Comisión Federal de Telecomunicaciones, Cofetel). The procedure first began on February 7th, 2013 and the second on February 17th, 2014.

For the third disagreement, the application was filed on November 4th, 2014, after the publication and entry into force of the decree establishing the Federal Telecommunications and Broadcasting Law are issued.

The subscriber base of wireless broadband in the country amounted to 47,284,849 in June 2014, whereby a penetration of 39.9 subscribers per 100 inhabitants with access to band wireless broadband was reached, which includes satellite services (08%), fixed wireless (1.11%) and Mobile Broadband (98.8%).

This level of subscriptions can be explained in part by the incursion of new prepayment schemes in the mobile market, which incorporates access or services, such as social networks that are available to a large volume of prepaid subscribers that exist in Mexico as well as by increased competition for postpaid contract users by mobile operators. With this, Mexico moves and positions with penetration levels above Hungary, Turkey, Portugal and Greece, and very close to Chile.

According to the definition of the Organization for Economic Cooperation and Development (OECD), broadband subscriptions are those that have an announced speed of 256 kbps or higher. Subscriptions must allow Internet access via http and should be used to make a data connection via Internet Protocol on its previous three months. SMS messages and MMS do not count as an active interconnection of broadband Internet, even if they are delivered via IP. This indicator is measured in number of subscriptions per 100 inhabitants.

Besides, the Federal Telecommunications and Broadcasting Law provides measurements that the telecommunications and broadcasting sectors must adhere to internationally recognized methodologies that allow the measurement of progress and international comparison, while the regulator awarded best tools for information of concessionaires. Based on the above, the IFT adheres to international standards and uses variables consistent with those provided by the International Telecommunication Union (ITU) and the OECD, such as subscriptions with access at speeds greater than 256 kbps. With this methodological change revised from 2010 to penetration of mobile broadband wireless data is presented.

Moreover, the latest statistical report from the OECD on broadband shows that from December 2013 to June 2014, a penetration increase of 18.8% of mobile wireless broadband in our country was recorded, with this, Mexico ranks third place among the OECD countries that reported the highest growth percentage in penetration of this market.

In the case of fixed broadband, between December 2013 and June 2014, a growth in penetration for this service of 3.1% is observed, which places Mexico at number 12 of the countries with the highest percentage growth in penetration, above the OECD average.

During the first quarter of 2015, the IFT will publish a statistical report for the third quarter of 2014, in which the main indicators of the telecommunications sector will be included, the methodology of measurement shall be consistent with international best practices and guidelines used by the ITU and OECD. Among the main changes, the information will be provided with the highest level of disaggregation, in addition to the figures collected will be reflected directly from operators, avoiding as far as possible the preliminary or estimated data.

The Plenary of the IFT agrees that the termination of analog signals on open television in Tijuana will be on March 26th, 2015

 

• The SCT gave to the Institute the information that proves that a penetration level ofsignal receivers or able decoders for receiving digital broadcasts in 90% or more has been reached on the low-income households defined by SEDESOL in each coverage area

• With this, the IFT determined that it is appropriate to conclude with the transmission of analog signals of six television stations in this city of Baja California

• The concessionaires of broadcasted TV service operate already in digital format in the coverage areas in which the stations operate

 

On February 23 of this year, the Secretariat of Communications and Transportation (Secretaría de Comunicaciones y Transportes, SCT) sent to the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) the information on the penetration of able catchers to receive digital transmissions in low-income households, which were defined by the Ministry of Social Development (Secretaría de Desarrollo Social, SEDESOL) in the coverage areas of different stations of broadcast television serving in Mexicali, Baja California.

The information received by the SCT comprise:

i) The number of low-income households defined by Sedesol defined by each television broadcast station coverage area;

ii) The number of poor households defined by Sedesol in which there have been delivered able catchers to receive digital transmissions by coverage area of each television broadcast station; and,

iii) The percentage of penetration with suitable receivers for receiving digital broadcasts in low-income households defined by Sedesol in every area of coverage of each television broadcast station.

As provided in Nineteen Transitory Article of the Decree which was issued the Federal Telecommunication and Broadcasting Law, the Federal Telecommunications Institute shall conclude the transmission of broadcast analog television signals no later than December 31st of 2015, by area of coverage, once reached, in the appropriate area, a level penetration of 90% of low-income households defined by SEDESOL, with receivers or decoders capable of receiving digital signals.

For its part, Article 18th of the Transition to Digital Terrestrial Television (DTT) Policy provides that corresponds to the Plenary of IFT to solve the appropriate to fix the termination of analog transmissions, once the SCT to provide information showing that it has reached a penetration level with receivers or decoders capable of receiving digital broadcasts in 90% or more of the low-income households defined by SEDESOL in each coverage area.

To determine the conclusion of the analog signals is also necessary that the entire area of corresponding coverage and digital signals are transmitted. Once meet both assumptions, the IFT determine the date and time of the termination of analogue transmissions appropriate, which shall be considered a working day between the date of determination and the accomplishment of this, a period of at least 4 weeks, so that during this period can inform the public about the transition to digital television.

In this regard, the IFT confirmed that in each one of said stations transmitting in Mexicali Baja California, broadcast digital television transmissions are performed under the parameters authorized. Therefore, in an extraordinary meeting held today, the IFT Plenary determined that they credited the existing conditions provided in the actual legal framework.

According to the resolution of the Plenary, broadcast television stations with call distinctive XHAQTV, XHBC-TV, XHBM-TV, XHEXT-TV, XHMEE-TV and XHMEX-TV in Mexicali, Baja California, shall cease permanently their analog transmissions at 00:00 am on March 26th of 2015.

From now on, the IFT and concessionaires should inform the population of Mexicali on the date and certain time for completion of analog transmissions of said stations, of accordance with the provisions of the TDT Policy.

The IFT will continue its outreach campaign in different media, in order to keep people informed about the conclusion of analogue transmissions in the country.

The transition to digital terrestrial television involves a process of modernization in this service, various benefits to the population as, for example, receiving images and sound more fidelity and / or resolution that currently allow analog broadcasts and access wider range of content, through multiprogramming, among others.
