The Plenary of the Federal Telecommunications Institute approves to submit for public consultation the "Guidelines draft for collaboration on security and justice"

 

The principles of transparency and citizen participation are submitted for public consultation, in terms of the provisions of the Law

• The document contains the mechanisms of interaction between telecommunications companies and the security agencies and law enforcement for the cooperation to be effective and timely

• In the proposed draft guidelines not only the provisions of the Law are attended, also human rights are also safeguarded, as well as the protection of user privacy and personal data

• At no time record retention or content of communications is established

• It is proposed to establish special service code 066 (ZERO, SIX, SIX), as the only nationally harmonized number for the provision of emergency services

 

In compliance with the mandate in the Federal Telecommunications and Broadcasting Law, and to promote transparency and citizen participation, the Plenary of the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) agreed to issue, for public consultation, the proposed guidelines draft concerning to obligations on security and justice that concessionaires must comply and, where appropriate, authorized, for the cooperation with the competent authorities to be effective and timely.

For the preparation of the document is now to the consideration of society in general, various meetings with business chambers and associations of traders took place, as well as approaches to industry members and visits to the buildings of telecommunications services concessionaires to review technical aspects necessary for collaboration.

Also, in compliance with Section I of 190 Article of the Law, meetings with various levels of security and law enforcement in which opinions and considerations were heard for preparing the Draft.

It is noteworthy that the provisions in the Draft arise only provide the technical mechanisms for the fulfillment of the obligations under the Law. Committed to transparency and citizen participation, the document will be available for public consultation, comments and contributions on the website of the Institute, from November 12 to 27.

The Draft provides, inter alia, the following:

• The authorities and concessionaires should work through electronic systems, safe and efficient information.

• The communications information data that concessionaires and authorized are required to maintain under the law, may only be required by the authorities explicitly empowered in this legal framework.

• The expedited service suspension equipment or mobile terminal devices reported as stolen or lost at the request of the holder is expected.

• It should be carried out awareness campaigns about the risks associated with counterfeit handsets or do not meet the standards or rules.

• The harmonization of a national single number 066 to provide free emergency services to the population is established.

• Measures for the reception on mobile devices early warning in case of emergency no cost to the user.

Thus, the IFT fulfills its legal mandate through an open society, commitment to transparency process.

The Federal Telecommunications Institute decided to impose fines and declare the forfeiture of assets involved of four radio stations and one television station that operated without permit or concession for the benefit of the nation

 

  • The IFT will maintain the validation and supervision actions in order to guarantee that these services are offered observing the law strictly
  • The Plenary received a report wherein the Office of Radio and Television Systems considers which signals broadcasted by Federal Public Institutions are technically available to be broadcasted again by the concessionaires of television service by subscription

 

Today, during the X Extraordinary Session, the Plenary of the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT), decided to impose different penalties and declare the assets forfeiture destined to the operation of four radio stations to the benefit of the Nation; these stations broadcasted on the FM band in the States of México and Sonora, as well as on Channel 3 of television in Chihuahua, that had no concession or permit.

As part of the validation actions conducted by the Institute to supervise the proper use of the radio spectrum, this regulating body made visits of preventive seizure to the domiciles where such stations operated so as to prevent them from continue broadcasting. As a result of these proceedings and of the administrative process conducted, the absence of the concession certificates or permits that would prove the legal operation of the stations was evidenced in conclusive manner.

In this manner, the IFT Plenary established, based on Articles 101, subsection XXIII, 103, 104 bis and 106 of the Federal Radio and Television Law, to impose penalties and declare the forfeiture to the benefit of the Nation of the assets destined to operate stations in the following frequencies and locations:

With these actions, the IFT confirms its commitment to continue with the actions of surveillance so broadcasting in Mexico is provided according to the terms set forth in the Law.

Conversely, the Plenary Session received the report whereby the Office of Radio and Television Systems considers that the different signals broadcasted by Federal Public Institutions are technically available to be broadcasted again by the concessionaires of television services by subscription, General Guidelines to broadcast again signals broadcasted in the systems of television services by subscription (must offer and must carry) in terms of Article 12, published in the Federal Official Gazette on February 27th of 2014. According to the provisions of Article 12 of the General Guidelines, the IFT will publish in the Federal Official Gazette such list with its technical characteristics, whereby the obligation of the pertinent television concessionaires of television services by subscription to broadcast them again will be demanded.

IFE and IFT sign a framework agreement for collaboration for broadcasting media monitoring

 

The Federal Electoral Institute (Instituto Federal Electoral, IFE) and the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) signed the framework agreement for collaboration for technical support in the field of media broadcasting monitoring , use of equipment, facilities and exchange of information and digital files belonging to the electoral body. This agreement, signed by IFE Minister President Benito Nacif and IFT Commissioner President Gabriel Contreras Saldivar, deepen the bonds of collaboration between the two independent agencies, which will be able to share information, technical expertise and technology platforms in order to strengthen the exercise of their legal powers in the field of radio and television. In the presence of the Electorate Counselor, María Marván, of the Electorate Advisers, Marco Antonio Baños and Lorenzo Córdova; of the IFT Commissioners, María Elena Estavillo, Sofía Labardini, Fernando Borjón, Mario Fromow, Ernesto Estrada and Adolfo Cuevas, as well as the Executive Secretary, Edmundo Jacobo; the Acting President Adviser, said that this agreement represents a partnership that is indispensable for the proper functioning of the Mexican State and its institutions. Benito Nacif said that the IFE and IFT collaboration in this task will allow us to provide coherence to regulation and achieve the necessary harmony to provide certainty to the obligors and provide guarantees to the citizens on the correct functioning of the political communication model. The Interim Chairman CEO reiterated that the challenge is to better regulate, meaning an adequate, accurate control and the least intrusive as possible of the regulated activities of the Press Release subjects, while safeguarding the rights of the citizens and the prerogatives of the political parties. During the signing of the agreement, the IFT President Commissioner expressed his conviction that this legal instrument will allow to consolidate fluent communication between both institutes, as well as to optimize the use of the infrastructure and installed capacity of both agencies. "Both the Federal Electoral Institute and Federal Telecommunications Institute have powers related to transmissions in the broadcasting field, and while both were created for different purposes and are based on different constitutional principles, they require similar ̶in some cases identical ̶mechanisms to support the constitutional mandate that founded them", Contreras Saldivar said. The IFT President reiterated that "the collaboration agreement that we endorse today will involve an efficient exercise of public resources, through the optimum use of the infrastructure and the capacity installed by both agencies, so as to share information, experiences and technical elements that provide the best exercise of the powers that both agencies have entrusted to us". In turn, the President of the IFE Radio and Television Commission, Electoral Adviser Lorenzo Córdova, said that with this agreement a strategic alliance materializes which will strengthen the Mexican State in its role as industry regulator, which will allow radio and television concession holders have coordinated and unambiguous replies which will translate into clarity and legal certainty. Both IFT and IFE, in their respective fields, have powers related to broadcasting transmissions, particularly since the electoral reform of 2007-2008, which defined the electoral body as the sole authority for the administration of Radio and Television time for electoral purposes. During the event that announced the collaboration agreement, the signatories agreed that both instances frequently require similar mechanisms, in some cases identical, to meet their constitutional obligations. IFE has developed an Integrated System for the Administration of State Times (Sistema Integral para la Administración de Tiempos del Estado, SIATE), which allows it to monitor transmissions for electoral purposes, broadcast both on radio and on television, and adhere to the regulations and the guidelines defined by the authority. IFT has a national radio monitoring network to carry out its monitoring functions and frequencies spectrum. These are some of the potential areas of collaboration, among others, that will have to be defined from the signing of the agreement. The cooperation agreement, signed in the IFE premises, envisages the creation of an "Ad-hoc Expert Group", comprising representatives of both institutions, which will evaluate and define the scope, mechanisms and instruments for collaboration and exchange. The cooperation agreement signed between IFE and IFT entails and furthers a natural alliance between two autonomous bodies of the Mexican State, which will strengthen their ability to fully comply their legal and constitutional powers with efficiency and opportunity.
