The Plenary of the Federal Telecommunications Institute approves to submit for public consultation the "Guidelines draft for collaboration on security and justice"
• The principles of transparency and citizen participation are submitted for public consultation, in terms of the provisions of the Law
• The document contains the mechanisms of interaction between telecommunications companies and the security agencies and law enforcement for the cooperation to be effective and timely
• In the proposed draft guidelines not only the provisions of the Law are attended, also human rights are also safeguarded, as well as the protection of user privacy and personal data
• At no time record retention or content of communications is established
• It is proposed to establish special service code 066 (ZERO, SIX, SIX), as the only nationally harmonized number for the provision of emergency services
In compliance with the mandate in the Federal Telecommunications and Broadcasting Law, and to promote transparency and citizen participation, the Plenary of the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones, IFT) agreed to issue, for public consultation, the proposed guidelines draft concerning to obligations on security and justice that concessionaires must comply and, where appropriate, authorized, for the cooperation with the competent authorities to be effective and timely.
For the preparation of the document is now to the consideration of society in general, various meetings with business chambers and associations of traders took place, as well as approaches to industry members and visits to the buildings of telecommunications services concessionaires to review technical aspects necessary for collaboration.
Also, in compliance with Section I of 190 Article of the Law, meetings with various levels of security and law enforcement in which opinions and considerations were heard for preparing the Draft.
It is noteworthy that the provisions in the Draft arise only provide the technical mechanisms for the fulfillment of the obligations under the Law. Committed to transparency and citizen participation, the document will be available for public consultation, comments and contributions on the website of the Institute, from November 12 to 27.
The Draft provides, inter alia, the following:
• The authorities and concessionaires should work through electronic systems, safe and efficient information.
• The communications information data that concessionaires and authorized are required to maintain under the law, may only be required by the authorities explicitly empowered in this legal framework.
• The expedited service suspension equipment or mobile terminal devices reported as stolen or lost at the request of the holder is expected.
• It should be carried out awareness campaigns about the risks associated with counterfeit handsets or do not meet the standards or rules.
• The harmonization of a national single number 066 to provide free emergency services to the population is established.
• Measures for the reception on mobile devices early warning in case of emergency no cost to the user.
Thus, the IFT fulfills its legal mandate through an open society, commitment to transparency process.
