Who?

The holder of one or more concessions to install, operate and exploit a public telecommunications network granted under the Ley Federal de Telecomunicaciones y Radiodifusión.


When or in what cases?

In case it intends to transit to a Unique Concession for Commercial Use.

Format IFT-Transición, submitted before the Filing Office of the Federal Telecommunications Institute.


Legal basis:

Article 24 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

In case of a favorable resolution, the Unique Concession Title for Commercial Use will be issued, with the same validity as the original, starting on the date when the public telecommunications network concession subject to transition was granted, or, in case of various titles, with the longest validity starting on the date when the title with such validity was granted. 

 

Also, the Unique Concession Title for Commercial Use will establish as coverage commitments those cities, municipalities or states that were established in the corresponding original concession titles.

In case that the Federal Telecommunications Institute issues a warning to the interested party, the maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response.

Data:

1. In the case of individuals: name and, when applicable, commercial name, address in the national territory, electronic mail, telephone and Taxpayer’s Code.

2. In the case of legal entities: corporate name or denomination and, when applicable, commercial name, address in the national territory (street, external number, apartment, city or neighborhood, municipality or delegation, state and zip code), electronic mail, telephone and Taxpayer’s Code.

3. When applicable, name of the legal representative, with sufficient authority to file the request. In case that the Legal Representative is not accredited before the Federal Telecommunications Institute, the official transcript or certified copy of the instrument issued by a public attestor granting sufficient authority, as well as the legal representative’s identification, shall be attached to the IFT-Transición format.

4. Electronic Folio of the concession to be transferred into a Unique Concession for Commercial Use. In case of consolidation of various concessions, the Electronic Folio of a single one of them is sufficient.

1. Official transcript or certified copy of the instrument granted before a public attestor evidencing the authority of the legal representative, in case he or she is not already accredited before the Federal Telecommunications Institute.

2. Simple copy of the legal representative’s identification document.

3. Payment receipt of the duties stipulated in the Ley Federal de Derechos for the transition to unique concession or the consolidation of one or more concessions to install, operate and exploit a public telecommunications network.

At any time.

The interested party shall answer the warning within 30 business days. In case of not responding to said warning within the corresponding term, the Federal Telecommunications Institute will reject the procedure.

The term to respond to the warning may be extended only once for an equal term, on request from the interested party.

The concessionaires that compose economic interest groups of the relevant economic agents shall comply with the stipulations of articles 276 of the Ley Federal de Telecomunicaciones y Radiodifusión, y Décimo y Décimo Primero Transitorios del Decreto por el que se reforman y adicionan diversas disposiciones de los artículos 6o., 7o., 27, 28, 73, 78, 94 y 105 de la Constitución Política de los Estados Unidos Mexicanos, en materia de telecomunicaciones.


Legal basis:

Article 28 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

Amount

The following amount shall be paid for the transition to unique concession or consolidation of one or more concessions to install, operate and exploit a public telecommunications network: $12,395.69 (twelve thousand three hundred ninety five pesos 69/100 MXN).

Legal basis:

Article 174-C, section XII of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

The requester shall be in compliance with:

(i) Obligations provided for in the corresponding concession titles, and

(ii) Obligations arising from applicable laws on the subject of telecommunications, broadcasting and economic competition.
