Request for telecommunications services public rates registration in the Public Concessions Registry, using the Rate Registration Electronic System

Articles 177, section IX, and 205 of the Ley Federal de Telecomunicaciones y Radiodifusión, published in the Diario Oficial de la Federación on July 14, 2014.

Who?

1. Holders of unique concessions to provide all kinds of public telecommunications services for commercial or social use.

2. Holders of concessions to use, leverage and exploit frequency bands of the radio spectrum for specific use on the subject of telecommunications for commercial or social use.

3. Holders of concessions to occupy and exploit orbital resources for commercial or social use.

4. Holders of concessions to install, operate and exploit a public telecommunications network.

5. Holders of concessions to use, leverage and exploit frequency bands of the radio spectrum for specific use.

6. Holders of concessions to occupy geostationary orbital positions and satellite orbits.

7. Holders of concessions to exploit emission and reception rights of signals of frequency bands associated to foreign satellite systems that cover and may render service within the national territory.

8. Holders of authorizations to establish and operate or exploit a telecommunications service trader, not having the capacity of a concessionary.

9. Holders of concessions to exploit emission and reception rights of signals of frequency bands associated to foreign satellite systems that cover and may render service within the national territory.

10. Holders of permits to establish, operate or exploit a telecommunications service trader not having the capacity of a public network.


When or in what cases?

On the rate’s intended effective date.

1. Online through the electronic rates registration system, or

2. Through a free writing document presented at the facilities of the Federal Telecomunications Institute.


Legal basis:

Article 205 of the Ley Federal de Telecomunicaciones y Radiodifusión.

Once the end user rate or offer is duly registered in the Public Concessions Registry, the system will automatically send the corresponding acknowledgment to the requester by electronic mail, indicating:

1. Registration number.

2. Registration date.

3. Name of the registered end user rate or offer.

4. Electronic Folios of the Concessions, Permits or Authorizations under which the end user rate or offer was registered.

In those cases where issuance of Certification of Registration in the Public Concessions Registry has been requested, it will be made available to the interested party at the public Concessions Registry’s office after 5 business days from the registration of the end user rate or offer.

The concessionaire determines the validity term of the rate in the corresponding item of the Rates Electronic System. In case no time term is specified, the validity shall be understood as undetermined from the date of registration, until the same is cancelled or a new one is registered as substitute.

Immediate resolution. The end user rate or offer will become effective on the date of filing and registration of the corresponding electronic application and will be immediately published in the Public Concessions Registry’s Website.

Data:

1. The request for end user rate or offer registration shall specify the following:

1.1. Name of the end user rate or offer to be registered.

1.2. Electronic Folios of the Concessions, Permits or Authorizations under which the end user rate or offer will be registered. The Electronic Folio is the informatic document corresponding to and identifying each concession, license or authorization, and is assigned and published by the Public Concessions Registry of the Institute.

1.3. Services to be provided in exchange of the rate or offer to be registered.

1.4. Towns, cities, municipalities and/or states where the end user rate or offer will be applied.

1.5. Indication if the electronic registration relates to a rate for all users or a new offer, or if it is a substitute for a previously registered one, in which case the Number of Registration and Name of the rate or offer to be substituted shall be specified.

1.6. Specific validity term of the end user rate or offer to be registered. In case no time term is specified, the validity shall be understood as undetermined from the date of registration, until the same is cancelled or a new one is registered as substitute.

1.7. Fill out the Specific Registration Formats in the System for the end user rates or offers, and attach a file in PDF format with the details of all charges not included.

1.8. Explicit request for issuance of the corresponding Certification of Registration in the Public Concessions Registry, if needed.

2. The contents of the end user rate or offer shall indicate at least the following:

2.1. Description of the service(s) to be provided in accordance to the end user rate or offer to be registered.

2.2. The amount of the end user rate or offer, in Mexican pesos, legal currency in the Mexican United States, indicating both the amount before taxes, and the amount including taxes.

2.3. Measurement unit of the corresponding end user rate or offer.

2.4. The modules, packages, services and/or any other similar optional or additional feature related to the end user rate or offer to be registered. These may not be registered independently to the end user rate or offer.

2.5. For the specific case of restricted television service, en user rate or offer being registered shall be accompanied by the information relating to the channels included.

2.6. Application rules of the corresponding end user rate or offer.

2.7. Applicable penalties, if any.

1. Those interested in performing this procedure should have previously obtained the corresponding username and password to access the System, in accordance with the procedure “Request to Access the Electronic Fee Registration System of the Public Concessions Registry”.

 

2. Upon compliance with the requisites to register an end user rate or offer, it shall be deemed as formally registered in the corresponding Electronic Folio of the Public Concessions Registry, and the Rate Registration Electronic System will assign registration date and sequential registration number. 

 

3. In those cases where an amendment to the information on a registered rate is intended, a new request for registration of end user rates or offer shall be filed. 

 

4. When the concessionaire, licensee or authorized party, for any reason, ceases application of a registered end user rate or offer, it shall cancel it in the Rate Registration Electronic System, without prejudice of honoring those rates previously contracted by the users. When the cancellation of a rate or offer is not registered in the Rate Registration Electronic System, it shall be deemed as valid and applicable, and, consequently, may be enforceable by the users who so request it, and the concessionaire or authorized party will be bound to offer and provide it to such users.

 

5. The federal Telecommunications Institute may, at any time, verify the truthfulness and precision of the information provided for the registration of an end user rate or offer, as well as request any relevant information on the registered rate or offer to allow verification of compliance with applicable regulations.

 

6. For those cases when a concessionaire, licensee or authorized party registers an end user rate or offer related to a service not authorized by its corresponding concession, authorization or license; does not pay due attention to any requirement by the Federal Telecommunications Institute on the matter or when the registered rate does not comply with applicable regulations on the subject, the Federal Telecommunications Institute, through its Concessions and Services Unit may cancel the registered end user rate or offer, same that may not be applied by the concessionaire, licensee or authorized party from the date of formal notice of the corresponding cancellation act. The preceding without prejudice of the penalties that may arise in terms of the Ley Federal de Telecomunicaciones y Radiodifusión.

 

7. In case that an end user rate or offer is filed for registration with an identical name or service already offered with different pricing in a previously registered one, and no indication is given that it substitutes the preceding, both end user rates or offers will be deemed as valid and the users shall be entitled to demand the most beneficial.

 

8. An end user rate or offer which has been contracted by the users during its validity shall be honored in its terms and conditions as stipulated in the corresponding contract, regardless of its substitution or cancellation. The preceding, without prejudice that the end user rate or offer may be amended in the terms stipulated in the corresponding contract with the end users.
