Articles 159, 166, 167 and 169, of the Ley Federal de Telecomunicaciones y Radiodifusión, published in the Federal Official Gazette on July 14, 2014.

Who?

Concessionaires who provide restricted broadcasted television, television or audio services.


When or in what cases?

1. Concessionaires that provide restricted television or audio services shall retransmit the multi-programmed broadcasted signal with the biggest audience free of charge.  In case of discrepancy, the Institute will determine the broadcasted signal to be retransmitted.  Restricted satellite television concessionaires are only bound to retransmit multi-program, broadcasted signals with a coverage of fifty per cent or higher of the biggest audience in the national territory.

 

2. Telecommunications or broadcasted television concessionaires who have been determined as holding substantial power in any of the telecommunications or broadcasting markets, or as relevant economic agents in terms of the Decree,  In case of discrepancy, the Institute will determine the rate under the principles of free competition and participation.

 

3. The obligation to offer and retransmit broadcasted contents free of charge shall expire simultaneously when appropriate competition conditions are present in the broadcasting and telecommunications markets. This statement will be performed by the Institute in terms of this Law and the Ley Federal de Competencia Económica. In this case, the concessionaires will be free to agree upon prices and conditions of broadcasted contents retransmission. In case of discrepancy, the Institute will determine a cost oriented rate.

 

4. Concessionaires that provide restricted television or audio services shall retransmit broadcasted signals from federal public institutions, free of charge. In case the concessionaire does not have capacity to retransmit all signals, the Ministry of the Interior will indicate the concessionaire which one of the channels should be retransmitted. In case of disagreement, the Institute will resolve.

The decision finalizing the procedure will be final for all the matters stated by the interested parties and those ex-officio matters arising from the former; when applicable, the Federal Telecommunications Institute may decide over those matters and evaluate the evidence in file.

In the specific case, the stipulations of the Ley Federal de Telecomunicaciones y Radiodifusión relative to signal retransmission, as well as the General Guidelines for broadcasted television signal retransmission, General Guidelines for access to multi-programming, issued by the Federal Telecommunications Institute, and any applicable regulations on the subject in force.
