Who?

Holders of concessions to use, leverage and exploit frequency bands of the radio spectrum for specific use and to occupy and exploit orbital resources for commercial use.


When or in what cases?

During the previous year to the beginning of the last fifth of the frequency bands of the radio spectrum or orbital resources concession for commercial use’s validity.

Decision of the Plenary of the Federal Telecommunications Institute authorizing or denying the extension.

Articles 15, sections IV and VIII, 17, section I, and 114 of the Ley Federal de Telecomunicaciones y Radiodifusión.

Business or natural days, months:

1 year for the Federal Telecommunications Institute to resolve if public interest exists to recover the radio electric spectrum or orbital resources, in which case the concessionaire will be notified and the concession will be terminated upon conclusion of its validity.

 

In case that the Federal Telecommunications Institute determines non-existence of public interest to recover the radio spectrum or orbital resources, it will grant the extension within a term of 180 business days, provided that the concessionaire accepts the new conditions that the Federal Telecommunications Institute may establish, such as payment of a consideration, among others.

Duties shall be paid according to the following tariff: $13,791.53 (thirteen thousand seven hundred ninety-one pesos 53/100 MXN).

Legal basis:

Article 173-A, section II, of the Ley Federal de Derechos, taking into account the update provided for in the Omnibus Tax Ruling for 2017 and its addendum 19, published in the Federal Official Gazette on December 23, 2016.

1. That the request is filed during the previous year to the last fifth portion of the concession’s validity term.

2. That the concessionaire is up to date in the compliance of its obligations as stipulated by Law and any other applicable regulations, as well as its concession title.

3. That the Federal Telecommunications Institute notifies the concessionaires non-existence of public interest in the recovery of the radio spectrum or orbital resources.

4. That the concessionaire accepts in advance the new conditions that may be established, including payment of a consideration.
