Who?

The concessionaires or other individuals that require to install cross-border links.


When or in what cases?

In case that telecommunications equipment and transmission media need to be installed to carry cross-border traffic.

Duly signed request using the “IFT-Autorización-D2” format, submitted before the Filing Office of the Federal Telecommunications Institute.

Rule 16 of the Reglas de carácter general que establecen los plazos y requisitos para el otorgamiento de autorizaciones en materia de telecomunicaciones establecidas en la Ley Federal de Telecomunicaciones y Radiodifusión, published in the Federal Official Gazette on July 24, 2015.

Authorization.

Authorizations will be granted for a term of up to 10 years, which may be extended up to equal terms, provided that the authorized party requests it in writing within the previous year to the beginning of the last fifth portion of the corresponding Authorization.

Which is an integral part of  the Decision by which the Plenary of the Federal Telecommunications Institute issues the general application Rules that establish the timeframe and requisites for the granting of authorizations on the subject of telecommunications, stipulated in the Ley Federal de Telecomunicaciones y Radiodifusión, published in the Federal Official Gazette on July 24, 2015.

General information of the interested party.

1. Identity (nationality, name, denomination or corporate name).

1.1. In case of being an individual, the interested party shall accredit his or her nationality by the original or a certified copy of the following documents issued by Mexican authorities: birth certificate and copy of official identification document; certificate of Mexican nationality; naturalization certificate; valid passport; citizen identity badge; voter’s badge or National Military Service badge, or consular registration.

1.2. In the case of legal entities, the interested party may accredit its Mexican nationality by official transcript or certified copy of public deed where its incorporation is evidenced, duly registered in the Public Registry of Commerce, or a certified copy of the bylaws in force. The nationality of public agencies, entities or institutions will be accredited by their legal existence in accordance with the applicable regulations related to their legal nature.

2. Address and contact information.

2.1. Address designation within the national territory (street, external number, apartment, town or neighborhood, municipality or delegation, state and zip code).

2.2. It will be accredited with a simple copy of a receipt of electric power, water, telecommunications services, property tax, leasing, gratuitous loan or similar agreement, issued during the previous three months, counting from the filing date, as well as contact telephone numbers and electronic mail.

2.3. A legal entity shall accredit its corporate or legal address, or the place of business or headquarters or branch office.

Also, it may indicate a different Address for service from the Federal Telecommunications Institute and, when applicable, the interested party may authorize agents for service.

3. Legal representation.

3.1. For legal entities and, when applicable, individuals, the identity and authority of the legal representative will be accredited with an official transcript or certified copy of the legal instrument granted before a public attestor where at least general authority for administration acts is granted, attaching a simple copy of the legal representative’s official identification (any of those indicated in section 1.1 of the preceding number 2). When applicable, the interested party may appoint agents for service;

4. Electromagnetic compatibility study.

5. Electronic format listing indicating the cross-border links intended for authorization;

6. Agreement subscribed with the Foreign Operator, expressly stating the following:

6.1 That voice Private International Traffic carried through the Cross-border Link may not be routed to public telecommunications networks in the national territory or to telecommunications networks that trade or exploit telecommunications services abroad.

6.2. That the Cross-border Link may not be connected to public telecommunications networks in the national territory or to telecommunications networks that trade or exploit telecommunications services abroad,

6.3. That no voice Public International Traffic will be carried through this Cross-border Link.

The Federal Telecommunications Institute will analyze and evaluate the documentation of the requests for Authorization in order to verify compliance with the corresponding requisites to issue a decision within the indicated term.

The requests for the installation of Cross-border Links to carry Private International Traffic that involve the use of the radio spectrum will only be authorized when the frequency bands have been favorably coordinated according to the frequency coordination procedure established for such effects with the telecommunications authority of the country involved in such cross-border links.

The federal Telecommunications Institute will register those Authorizations, notices and amendments that, when applicable, are approved, in the Public Concessions Registry, within 15 business days following the date of notice to the applicant on the granting of the corresponding Authorization or modification or, when applicable, from the day following the filing or the corresponding notice before the Federal Telecommunications Institute.
