Who?

Parties interested in obtaining authorization to exploit emission and reception rights of signals and frequency bands associated to foreign satellite systems that cover and may provide service within the national territory.


When or in what cases?

In case that they need to exploit emission and reception rights of signals and frequency bands associated to foreign satellite systems that cover and may render service within the national territory to perform their activities.

Duly signed request using the Format “IFT-Autorización-C”, submitted before the Filing Office of the Federal Telecommunications Institute.


Legal basis:

Rule 11 of the Reglas de carácter general que establecen los plazos y requisitos para el otorgamiento de autorizaciones en materia de telecomunicaciones establecidas en la Ley Federal de Telecomunicaciones y Radiodifusión.

Authorization.

Authorizations will be granted for a term of up to 10 years, which may be extended up to equal terms, provided that the authorized party requests it in writing within the previous year to the beginning of the last fifth portion of the corresponding Authorization.

After the established term, if not resolved, they will be taken as granted, and the corresponding Approval must be issued within the following 30 business days.

Which is part of the Agreement whereby the Federal Telecommunication Institute’s Plenum grants the Reglas de carácter general that establish the terms and requirements for the granting of approvals in telecommunications established in the Ley Federal de Telecomunicaciones y Radiodifusión published in the Diario Oficial de la Federación on July 24, 2015 and its modifications published on June 7, 2018 in the Diario Oficial de la Federación.

1. Identity (nationality, name, denomination or corporate name).

2. Address and contact information.

3. Legal representation.

4. Name of the satellite or satellites. 

5. Name of the foreign operator, and

General Information of the Interested Party.

 

1. Identity (nationality, name, company name or business name).

 

1.1. In case the interested party is a natural person, he/she must show proof of his/her Mexican nationality, with the original or a certified copy of one of the following documents issued by Mexican authorities: birth certificate and ID copy: Mexican nationality certificate; naturalization certificate; valid passport; citizen identity card; voting credential or military service card or consular registration card.

 

1.2. In the case of legal entities: the interested party can show proof of its Mexican nationality through testimony or a certified copy of the public deed where it shows proof of the articles of incorporation duly subscribed in the Registro Público de Comercio or, a certification of the current social statutes. The premises, entities or public institution’s nationalities will be proven with their legal existence in accordance to the regulation that is applicable to them, derived from the kind of entity.

 

1.3. In case the applicant possesses or intends to use a commercial name or brand, it is convenient that he/she informs the Institute in the provided section in the corresponding Format.

 

2. Address. Address to listen to and receive notifications and, when applicable, email address for electronic notices (such information shall be treated by the Federal Telecommunication Institute according to the applicable regulation of the subject of matter.)

 

2.1. Designation of address in national territory (street, exterior number, interior number, locality or neighborhood, municipality, district, federative entity and postal code).

 

Proof will be considered with a simple copy of the electricity bill, water bill, telecommunication services bill, property tax bill, leasing agreement, commodatum agreement or similar, with a maximum issuing date of three months prior to the date of submission, as well as telephone numbers and email addresses.

 

In the case of a legal entity, proof of its registered office, tax residence, settlement site of operations or headquarters or branch office must be provided.

 

2.2. The requester can indicate a different address to listen to and receive notices and documents.

 

2.3. With the submission of the request, the requester that so decides it, voluntarily will indicate in the corresponding Format, that he/she accepts that any requirement and/or prevention that is made by the Institute with supplementary or explanatory information purposes, as well as for missing requirements, be notified or sent to the indicated email address by the requester or his/her legal representative on such Format.

 

For the electronic notices, the Institute will use an institutional email address created for such purposes, which will be indicated in the corresponding Format. In the notice’s email address, a digital file will be attached that contains the image of the requirement initiative and/or formulated prevention, duly signed by a pertinent official and where the term that is granted for its presentation of evidence is stated. Such term will begin as of the next business day to the date the email was sent by the Institute.

 

In case the requester indicates that he/she voluntarily accepts the related prevention and/or requirement electronic notice with his/her Request, he/she will be able to submit through the same medium to the institutional email address, indicated by the authority in the corresponding Format upon answering, the information, documentation, explanations, requested in the requirement and/or prevention notified by electronic means, except for that documentation that, because of its nature, must be submitted in certified copy or issued by a notary public, to unequivocally prove or with total proof of some fact or circumstance to meet a requirement. This documentation must be submitted, when applicable, to the Central Filing Office (oficialia de partes común) of the Institute.

 

3. Legal Representation.

 

3.1. For legal entities and, when applicable, for natural persons, the identity and power of the legal representative will be proven with testimony or with a certified copy of the granted instrument before a public notary where there is proof to hold at least power to generate the administrative acts, attaching a simple copy of the legal representative’s ID (any of the mentioned in section 1.1 of part 1 above.) When applicable, the interested party can authorize people to listen to and receive notices.

 

4. Documentation that proves he/she has the technical capabilities;

 

5. A copy of the record of the satellites before the International Telecommunication Union and their status;

 

6. The requested satellite or satellites general characteristics (Data sheet);

 

7. The Secretariat of Communications and Transport’s (Secretaría de Comunicaciones y Transportes),favorable opinion in regards to the state of coordination of the requested foreign satellite network;

 

8. Contract or agreement that proves:

 

8.1. The legal relationship between the foreign satellite operator and the interested party that would exploit the system in national territory, and

 

8.2. That the interested parties will keep control of the provided services in national territory.

                                                                                                                     

9. Proof of payment for the rights or uses (see how to submit it before the Institute).

15 business days, in writing and only once, to correct omissions within the term established by the Institute, which may not be less than 5 business days from the date following notice.

Article 174-H, fraction I, of  the Ley Federal de Derechos, considering the expected update in the Modification to the Anexo 19 of the Resolución Miscelánea Fiscal  para 2018, published in the Diario Oficial de la Federación on December 21, 2018.

The Federal Telecommunications Institute will analyze and evaluate the documentation of the requests for modification in order to verify compliance with the corresponding requisites to issue a decision within the indicated term.

The Federal Telecommunications Institute will register those Authorizations, notices and amendments that, when applicable, are approved, in the Public Concessions Registry, within 15 business days following the date of notice to the applicant on the granting of the corresponding Authorization or modification or, when applicable, from the day following the filing or the corresponding notice before the Federal Telecommunications Institute.
