Article 17, second paragraph, of the Lineamientos Generales sobre la Autorización de Arrendamiento de Espectro Radioeléctrico, published in the Diario Oficial de la Federación on March 30, 2016.

Who?

In the case of leasing, natural person or legal entity (Lessor) that has a radio spectrum concession title for current commercial use or a radio spectrum concession for private use, for private communication purposes, in force.

 

In the case of subletting, natural person or legal entity (Sublessor) who has the express consent of the Landlord in the Lease Agreement to sublease, in whole or in part, the use, and / or exploitation of one or more frequency bands subject matter of the Leasing contract.


When or in what cases?

In the case of a modification in the rent or price of the Contract of Lease or the Sublease Contract of the radio frequency spectrum bands, the Federal Telecommunications Institute must be informed of the rent or the price agreed by the interested parties, with at least 15 business days before the respective modification takes effect.
