Provision Fourteenth of the Acuerdo mediante el cual el Pleno del Instituto Federal de Telecomunicaciones expide la metodología de separación contable aplicable a los agentes económicos preponderantes, agentes declarados con poder sustancial de mercado y redes compartidas mayoristas, published in the Federal Official Gazette on December 29, 2017.

Who?

Concessionaires and/or authorized parties that constitute the preponderant economic agents, agents holding substantial market power and wholesale shared networks.


When or in what cases?

Concessionaires and/or authorized parties shall submit, for authorization by the Institute, an implementation program for the accounting separation methodology at the end of the first quarter of the year following their declaration as preponderant economic agents, holding substantial market power and/or having been granted a concession as a wholesale shared network.

The implementation program shall be submitted before the Filing Office of the Federal Telecommunications Institute, in an electronic and editable format, in a compact disc and/or storage device.

The implementation program will be deemed as approved unless the Federal Telecommunications Institute requests modifications to its contents within 40 business days from its date of submission, in which case the concessionaire and/or authorized party shall address such requirement and submit the modified implementation program within 20 business days. In case that the implementation program does not address the requested modifications, it will be deemed as not submitted. The maximum term for approval by the Federal Telecommunications Institute in this last case is 3 months.

The implementation program shall include a proposal on the way in which the accounting separation information will be delivered in conformity with the stipulations of the methodology and its sections, and shall include at least the following information:

1. Services subject of the accounting separation to be disaggregated and their detailed description.

2. Definition, justification and description of the cost and income accounts disaggregated in each one of the levels of the model;

3. Debit and credit causes for each account and the distribution or assignment criteria on which they are based;

4. Information to be used and an explanation of the proposed methods to comply with CHAPTER III of this methodology, and

5. Proposal and justification of the assets’ life cycles.

The concessionaires and/or authorized parties who constitute a single preponderant economic agent or holding substantial market power may request authorization from the Federal Telecommunications Institute to submit the accounting separation information jointly, as part of their implementation program, if they so desire.

The Federal Telecommunications Institute reserves the right to revoke or modify any authorization of joint submission of the accounting separation. To this purpose, it will notify the concessionaires and/or authorized parties on such situation so that they deliver the information on accounting separation for the following year in the terms stipulated by the Federal Telecommunications Institute.

The concessionaires and/or authorized parties that upon the effective date of the methodology included in the Resolution by which the Governing Board of the Federal Telecommunications Institute issues the methodology for accounting separation applicable to preponderant economic agents, agents holding substantial market power and wholesale shared networks, those who are part of a preponderant economic agent, holding substantial market power and/or have been granted a concession as wholesale shared network, shall submit for a single occasion the implementation program stated in ruling Fourteenth of said resolution within 40 business days following its effective date, which term may be extended one single time for up to 20 business days. 

The implementation program will be deemed as approved unless the Federal Telecommunications Institute requests modifications to its contents within 40 business days from its date of submission, in which case the concessionaire and/or authorized party shall address such requirement and submit the modified implementation program within 20 business days. In case that the implementation program does not address the requested modifications, it will be deemed as not submitted. The maximum term for approval by the Federal Telecommunications Institute in this last case is 3 months.
