Who?

Mexican individuals and legal entities for non-profit cultural, scientific, education or community purposes, and private higher education institutions; civil society organizations incorporated under the principles of direct citizen participation, social coexistence, fairness, gender equality and plurality, as well as indigenous towns and communities in the country.


When or in what cases?

When a person desires a unique concession title for social use, social community use or social indigenous use, to provide non-profit telecommunications services for cultural, scientific, educational or community purposes; in the case of indigenous towns and communities for the purpose of promoting, developing and maintaining their languages, culture and knowledge, promoting their traditions, internal rules and under principles of gender equality, allowing the integration of indigenous women to participate in the objectives for which the concession is requested, and all other elements constituting their culture and identity.

Using the corresponding format, submitted before the Filing Office of the Federal Telecommunications Institute:

IFT-Concesión Única format. Type B1, Social Use

IFT-Concesión Única format. Type B2, Community Social Use.

 

IFT-Concesión Única format. Type B3, Indigenous Social Use.

 


Legal basis:

Articles 3 and 13 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el Título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

In case of a favorable decision, a Unique Concession for Social Community or Social Indigenous Use Title, with a validity of up to 30 years, will be issued.

 

In case of an unfavorable decision, it will be notified to the interested party at the address indicated for such purpose.

In case that such warning is not answered within a term of 30 business days, the Federal Telecommunications Institute will reject the procedure.

The maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response. Such term may be extended one single time for an equal term upon request of the interested party, which shall be submitted by free form document within the granted term.

Indigenous communities will not be bound to submit digital versions of the documents referred in the corresponding formats.

Amount

1. The amount to be paid for the issuance of a unique concession title for social use is $3,725.45 (three thousand seven hundred twenty five pesos 45/100 MXN), equivalent to 20% of $18,627.27 (eighteen thousand six hundred twenty seven pesos 27/100 MXN), in accordance with the stipulations of the Ley Federal de Derechos. 

 

2. No duties will be paid for issuance of a unique concession title when the service is linked to concessions for social communitary or indigenous use.

Legal basis:

Articles 174-B, section II, subsection a), and 174-I, sections II and III of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

The Federal Telecommunications Institute will take into account that all mandatory information in the corresponding format is duly integrated, complete.

The Federal Telecommunications Institute will provide an electronic system for the reception and processing of the requests to obtain any of the concessions, in accordance with article Seventh Transitory of the General guidelines for the granting of concessions referred in Title fourth of the Ley Federal de Telecomunicaciones y Radiodifusión.

 

In the case of Concessions for Social Community Use and Concession for Indigenous Community Use, the Federal Telecommunications Institute shall provide legal, engineering and/or administrative assistance, prior the filing of the request and during the procedure to obtain the corresponding concessions, to facilitate compliance with the corresponding requisites. To request technical assistance, the interested party shall contact the Concessions and Services Unit of the Federal Telecommunications Institute by a free form document, in printed copy or by electronic means, to indicate contact information to schedule and provide the required assistance.

 

In those cases of justified necessity, such assistance may be required by a telephone call in which verifiable contact information is provided, in accordance with article 14 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el Título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.
