Authorized parties interested in transferring the rights of their Authorization titles to exploit emission and reception rights of signals in frequency bands associated to foreign satellite systems.

When it is the best interest of the authorized party to transfer the rights stipulated in the corresponding Authorization title.

Documents:

The petitioner shall attach to its document the documents that evidence his or her capacity, as well as those required in each case by the corresponding regulations. Additionally, the following shall be delivered:

General information of the interested parties.

1. Identity (nationality, name, denomination or corporate name ).

1.1. In case of being an individual, the interested party shall accredit his or her nationality by the original or a certified copy of any of the following documents issued by Mexican authorities: birth certificate and copy of official identification document; certificate of Mexican nationality; naturalization certificate; valid passport; citizen identity badge; voter’s badge or National Military Service badge, or consular registration.

1.2. In the case of legal entities, the interested party may accredit its Mexican nationality by official transcript or certified copy of public deed where its incorporation is evidenced, duly registered in the Public Registry of Commerce, or a certified copy of the bylaws in force. The nationality of public agencies, entities or institutions will be accredited by their legal existence in accordance with the applicable regulations related to their legal nature.

2. Address and contact information.

2.1 Address designation within the national territory (street, external number, apartment, town or neighborhood, municipality or delegation, state and zip code).

2.2. It will be accredited with a simple copy of a receipt of electric power, water, telecommunications services, property tax, leasing, gratuitous loan or similar agreement, issued during the previous three months, counting from the filing date, as well as contact telephone numbers and electronic mail.

2.3. A legal entity shall accredit its corporate or legal address, or the place of business or headquarters or branch office.

Also, it may indicate a different Address for service from the Federal Telecommunications Institute and, when applicable, the interested party may authorize agents for service.

3. Legal representation.

3.1. For legal entities and, when applicable, individuals, the identity and authority of the legal representative will be accredited with an official transcript or certified copy of the legal instrument granted before a public attestor where at least general authority for administration acts is granted, attaching a simple copy of the legal representative’s official identification (any of those indicated in section a) of the preceding number 2). When applicable, the interested party may appoint agents for service;

4. The corresponding duties or exploitations payment receipt.

In case the indicated warning is not issued in due time and manner, the Federal Telecommunications Institute may not reject the procedure or service on the grounds of being incomplete. Otherwise, the maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response.


Legal basis:

Article 17-A, second paragraph, of the Ley Federal de Procedimiento Administrativo.

1. Approval by the Federal Telecommunications Institute is not required in those cases of transfer of Authorization by corporate merger, separation or restructuring, provided that such acts take place within the same controlling group or economic agent. To this effect, the corresponding transaction shall be notified to the Federal Telecommunications Institute within 30 calendar days from its execution for its proper registration in the Public Concessions, delivering the documentation evidencing those acts.

2. Authorizations held by the Powers of the Union, States, Government Agencies of the Federal District, Municipalities and constitutional autonomous agencies may be transferred to public entities, even under public-private partnership schemas, with previous authorization by the Federal Telecommunications Institute.

Amount

Duties shall be paid according to the following tariff: $3,131.00 (three thousand one hundred thirty-one pesos 00/100 MXN).

Legal basis:

Article 174-I, section II of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

The federal Telecommunications Institute will register those Authorizations, notices and amendments that, when applicable, are approved, in the Public Concessions Registry, within 15 business days following the date of notice to the applicant on the granting of the corresponding Authorization or modification or, when applicable, from the day following the filing or the corresponding notice before the Federal Telecommunications Institute.
