Articles 3 and 4 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el Título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión, published in the Federal Official Gazette on July 24, 2015.

Who?

Individuals or legal entities that render public telecommunications and broadcasting services commercially, through a public telecommunications network.


When or in what cases?

When individuals or legal entities desire a Sole Concession Title for Commercial Use.

Free form document accompanied by Format IFT-Sole Concession (Type A. Commercial Use) submitted before the Filing Office of the Federal Telecommunications Institute.


Legal basis:

Articles 3 and 13 of the general guidelines for the granting of concessions referred in Title fourth of the Ley Federal de Telecomunicaciones y Radiodifusión.

In case of a favorable resolution, a Unique Concession for Commercial Use Title, with a validity of up to 30 years, will be issued.

In case of an unfavorable resolution, it will be notified to the interested party at the address indicated for such purpose.

60 calendar days.

In case that the Federal Telecommunications Institute issues a warning to the interested party, the maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response.

The interested party shall answer the warning within 30 business days. In case of not responding to said warning within the corresponding term, the Federal Telecommunications Institute will reject the procedure.

The term to respond to the warning may be extended only once for an equal term, on request from the interested party.
