Article 6 of the Acuerdo de Reconocimiento Mutuo entre el Gobierno de los Estados Unidos Mexicanos y el Gobierno de los Estados Unidos de América para la evaluación de la conformidad de equipos de telecomunicaciones, published in the el Diario Oficial de la Federación on July 28, 2011.

Who?

A Foreign Regulating Agency with which Mexico has signed a Mutual Recognition Agreement on the subject of Telecommunications, who desires that a third party Testing Laboratory incorporated abroad and designated by a Designation Authority of a Foreign Government (United States of America or Canada) be recognized by the Federal Telecommunications Institute to execute Conformity Evaluation tests in terms of a Mutual Recognition Agreement.


When or in what cases?

When the Federal Telecommunications Institute is notified in writing by its homologous in relation to the Designation of a third party Testing Laboratory incorporated abroad, in terms of the corresponding Mutual Recognition Agreement.

Presented preferably through the Sistema de Organismos de Evaluación de la Conformidad ("SOEC"), through the following electronic link https://laboratorios.ift.org.mx/laboratorios/web/index.php, or through writing in free writing document , presented at the Filling Office of the Federal Institute of Telecommunications.

Recognition or Non-Recognition of the third party Testing Laboratory designated by a Designating Authority of a Foreign Government (Canada or the United States of America).

60 calendar days following the date of notice of the foreign Testing Laboratory’s Designation.

In case the maximum response term has concluded and Federal Telecommunications Institute has not issued any decision, opinion or notice related to the filed request, the decision shall be understood as unfavorable. In accordance with the stipulations of article 17 of the Ley Federal de Procedimiento Administrativo.

3. Identification number granted by the Designating Authority.

 

4. An indication if the foreign Testing Laboratory executes tests for other entities.

 

5. The accredited Technical rule or section.

 

6. Expiry date and accreditation term (which shall be of 2 years).

 

7. Compliance of the functions and responsibilities of the Accredited Testing Laboratory.

A term of no less than 60 calendar days from the date of notice will be provided for the foreign Testing Laboratory to submit information answering or correcting any deficiency indicated by the Federal Telecommunications Institute.

The Federal Telecommunications Institute will evaluate and decide on the Recognition of the Testing Laboratory in terms and conditions no less favorable to those granted to national Testing Laboratories who request to be designated in terms of the Guidelines for the accreditation, authorization, appointment and recognition of testing laboratories and the corresponding Mutual Recognition Agreement.

Once foreign third party testing laboratory is acknowledged, it can issue the corresponding test reports, which must be in Spanish, the latter based on the Article 13, numeral 2 of the “Acuerdo de Reconocimiento Mutuo entre el Gobierno de los Estados Unidos Mexicanos y el Gobierno de Canadá para la evaluación de la conformidad de equipos de telecomunicaciones” and the Article 13, numeral 2 of the “Acuerdo de Reconocimiento Mutuo entre el Gobierno de los Estados Unidos Mexicanos y el Gobierno de los Estados Unidos de América para la evaluación de la conformidad de equipos de telecomunicaciones”.
