Civil society organizations that do not pursue or operate for profit and that are constituted under the principles of direct citizen participation, social coexistence, equity, gender equality and plurality. 


When or in what cases?

When it is desired to obtain a radio spectrum concession title and, when applicable, a unique concession title, both for community social use to provide telecommunications services.

Using the IFT-Spectrum Radioelectric Concession. Type C2. Community Social Use Format, submitted before the Filing Office of the Federal Telecommunications Institute.


Legal basis:

Articles 3, 8, first paragraph, sections I and III, and 13 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

In case of a favorable decision, the following will be issued: a concession title on radio spectrum and, when applicable, a unique concession title, both for social use, with a validity of up to 15 and 30 years, respectively.

 

In case of an unfavorable decision, it will be notified to the interested party at the address indicated for such purpose.

In case that such warning is not answered within a term of 30 business days, the Federal Telecommunications Institute will reject the procedure. The maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response. Such term may be extended one single time for an equal term upon request of the interested party, which shall be submitted by free form document within the granted term.

Article 173-C, section I, and 174-L, sections I and III of the Ley Federal de Derechos, taking into account the update provided for in the Omnibus Tax Ruling for 2017 and its addendum 19, published in the Federal Official Gazette on December 23, 2016.

The Federal Telecommunications Institute will take into account that all mandatory information in the corresponding format is duly integrated, complete. 

 

Under the assumption that two or more requests to obtain radio spectrum concession for social use related to the same frequency bands and coverate area, the Federal Telecommunications Institute will consider, among others, the elements referred in sections I to VI and VIII of article 15 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

The Federal Telecommunications Institute will provide an electronic system for the reception and processing of the requests to obtain any of the concessions, in accordance with article Seventh Transitory of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

 

In the case of concessions for community social use, the Federal Institute of Telecommunications will provide technical assistance, at the request of a party, in legal, engineering, and / or administrative matters, before submitting the application and during the procedure to obtain the respective concessions for the facilitation of compliance with the corresponding requirements. To request technical assistance, the Interested Party must contact the Concessions and Services Unit of the Federal Telecommunications Institute through a free written document, physically or electronically, in order to indicate the contact information to schedule and provide the required assistance. In cases of justified necessity, such assistance may be required through a telephone call in which verifiable contact data are provided, in accordance with article 85, third paragraph, of the Ley Federal de Telecomunicaciones y Radiodifusión and the provisions of the Article 14 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

 

When the exploitation of the services subject matter of the radio spectrum concessions referred by the Guidelines require a unique concession, it shall be granted in the same administrative act, unless the concessionaire already holds this type of concessions, in accordance with Articles 75, second paragraph, of the Ley Federal de Telecomunicaciones y Radiodifusión,  and the stipulations of Article 5 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión.

 

In this case, the IFT-Unique Concession Type B2. Community Social Use Format will not be necessary; only the information requested in the IFT-Spectrum Radioelectric Concession. Type C2. Community Social Use Format shall be filled out format.
