Who?

Broadcasting concessionaires.


When or in what cases?

When the validity of the granted concession is about to expire, this is, during the previous year to the last fifth portion of the concession’s validity term.

Legal basis:

Article 15 of the Ley Federal de Procedimiento Administrativo.

In case of a favorable Decision, the Extension of Unique Concession for public or social use broadcasting is issued.

 

The unique concession will be granted for a term of up to 30 years and may be extended up to equal terms.

 

In case of an unfavorable resolution, it will be notified to the interested party at the address indicated for such purpose.

In case the indicated warning is not issued in due time and manner, the Federal Telecommunications Institute may not reject the procedure or service on the grounds of being incomplete. Otherwise, the maximum term for the resolution of the procedure or service will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party delivers response.

Amount

The amount to be paid is $1,648.24 (one thousand six hundred forty-eight pesos 24/100 MXN), which is equal to 20% of $8,241.22 (eight thousand two hundred forty-one pesos 22/100 MXN), in accordance to the Ley Federal de Derechos.

Legal basis:

Article 174-B, section II, subsection b), of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

1.  That the request has been filed before the Federal Telecommunications Institute during the previous year of the last fifth portion of the concession’s validity term.

2. That the request has been filed at least one year in advance to the expiration of the validity of the concession title (cases where the LFRTV is applicable).

3. That the concessionaire is up to date in the compliance of its obligations stipulated in the Ley Federal de Telecomunicaciones y Radiodifusión and other applicable regulations.

4. That the concessionaire has exercised a proper usage of the spectrum (cases where the LFRTV is applicable).

5. That the concessionaire accepts the new conditions that may be established.

6. That all information requests from the Federal Telecommunications Institute during the procedure are fulfilled in due time and manner by the concessionaire.

7. That the Federal Telecommunications Institute determines if public interest to recover the radio spectrum exists or not.

8. That the concessionaire has made all established payments of considerations, duties and exploitation. Concession titles will be delivered upon payment of the consideration established to this effect, and

9. That the applicant has accredited its legal capacity before the Federal Telecommunications Institute.

The capacity of the representative or proxy of the concessionaire that files or signs the corresponding request in its behalf shall be duly credited before the Federal Telecommunications Institute, otherwise, the document shall be accompanied by a legalized copy of the documents that credit said capacity.

Verification of the timeframe for the request in accordance to the validity of the concession is suggested.
