Sound Broadcasting Concessionaires who use the Amplitude Modulation band in the towns or cities indicated in Anexo 1 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada.


When or in what cases?

When a Sound Broadcasting Concessionaires who use the Amplitude Modulation band in the towns or cities indicated in Annex 1 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada, desires to request from the Institute the change of its bands to frequency modulation, during the term from January 19 to February 1, 2017

Request submitted before the Filing Office of the Federal Telecommunications Institute, accompanied by the Instructions Manual on the subject of Economic Competition, same that is included in Addendum 2 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada.

The request filed before the Federal Telecommunications Institute shall include:

 

1. Name, denomination or corporate name.

2. Legal accreditation of the capacity of the interested party and/or legal representative.

3. Commercial name or brand, when applicable.

4. Call sign, assigned frequency, main location/city to be serviced, issuance date, validity of the Concession of Permit.

5. Address for service.

6. Electronic mail and telephone number of the interested party and/or legal representative.

7. Fiscal Identification Card or Certification of Fiscal Registration, and

8. Information established in the Instructions on the subject of Economic Competition detailed in Addendum 2 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada.

Within 30 business days following the delivery of the corresponding Request for Frequency Change.

 

In case the Federal Telecommunications Institute issues a warning to the requester, the latter shall submit a response within 15 business days from the business day following the effective date of the corresponding notice.

 

In case the warning is not responded, the Federal Telecommunications Institute will reject the request.

 

 

In case the warning is issued, the maximum term for the resolution of the procedure will be suspended from the time of the corresponding notice and will be resumed on the following business day from the date when the interested party corrects the omission, clarification or defect.

Amount

Duties for the analysis of the request shall be paid according to the following tariff: $13,165.00 (thirteen thousand one hundred sixty-five pesos 00/100 MXN).

Only under the assumption that the Federal Telecommunications Institute authorizes the change of frequency, the concessionaire shall pay a consideration established by the Federal Telecommunications Institute, considering the type of station, the town or city to be serviced and the remaining validity term of the corresponding concession, among other elements, with the previous non-binding opinion of the Ministry of Finance and Public Credit.

Articles 7, first paragraph, and Third Transitory of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada.

1. Preference will be given to public use concession of the Federal Executive.

 

2. Frequency change will be granted to those interested parties who are not holders of concession to operate Frequency Modulation band broadcasting stations with coverage in the corresponding town or city or that, being a part of Economic Interest Groups, those do not have Frequency Modulation band stations with coverage in the corresponding town or city.

 

3. Upon granting of the change in the terms above, and in case frequencies are still available, the change of frequencies will be granted to the concessionaires that have only one Frequency Modulation band station in the town or city or whose Economic Interest Groups, in case of being part of any, have only one Frequency Modulation band station in the town or city.

 

4. In case frequencies in the Frequency Modulation band are still available, once granted the frequency changes in accordance with the preceding paragraphs, priority will be given on the assignment of such frequencies to the concessionaires or Economic Interest Groups that have less stations in the Frequency Modulation band in the town or city.

 

5. Only one frequency change will be authorized for each Economic Interest Group, with the exception of those towns or cities where frequencies are still available and Amplitude Modulation stations still exist.  In those cases, the available frequencies will be granted giving priority for the Economic Interest Groups that have less stations in the Frequency Modulation band.

 

6. Under equal circumstances, the requester that does not have any or has less concessions for broadcasted television service in the town or city will be privileged.

 

7. In those towns or cities where requesters under equal circumstances are still present, and frequency changes may not be granted in accordance to the criteria described above, the Institute shall raffle the frequencies among those concessionaires under equal circumstances.

 

8. The raffle will be held in the Institute’s facilities, where a representative of each interested party may be present, at the date and time notified to them, and will consist of placing vouchers with the name of each interested party in a black box which will be assembled in the presence of the attendants, so that an Officer of the Institute, before the presence of a social witness who certifies the transparency of the process, obtains the voucher(s) of the concessionaires who will be granted the change to the Frequency Modulation band.

 

9. The result of the raffle will be notified to the winners and published in the Website of the Federal Telecommunications Institute, and

 

10. Those concessionaires who have a station in the Frequency Modulation band by which they transmit the programming of an Amplitude Modulation station, simultaneously, in the same town or city of interest, may not request the frequency change referred herein.

Reading and taking into account the stipulations of the following document is suggested:

 

1. The Disposición Técnica IFT-002-2016: Especificaciones y requerimientos mínimos para la instalación y operación de estaciones de radiodifusión sonora en frecuencia modulada, published in the Federal Official Gazette on April 5, 2016.

 

2. The Acuerdo por el que se adopta el estándar para la radio digital terrestre y se establece la política para que los concesionarios y permisionarios de radiodifusión en las bandas 535-1705 kHz y 88-108 MHz, lleven a cabo la transición a la tecnología digital en forma voluntaria”, published in the Federal Official Gazette on June 16, 2011.

 

3. The contents of Article third transitory of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada, relating to the elements that the Institute shall consider to determine the amount of the consideration referred in article 7 therein, such as:  3.1 the type of station, 3.2 the town or city to be serviced, 3.3. the remainig validity term of the corresponding concession, and iv) other elements, as well as the previous non-binding opinion from the Ministry of  Finance and Public Credit.

 

Upon acceptance of the conditions imposed by the frequency change, the Concessionaire shall produce the receipt of payment for the consideration determined by the Institute within a term of 30 business days.

 

In case the Federal Telecommunications Institute reaches a favorable decision on the requested change of frequency band, the interested parties shall be bound by the stipulations of the aforementioned Laws. 

 

The document shall be addressed to the Head of the Concessions and Services Unit of the Federal Telecommunications Institute, in terms of Article 4 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada.

 

A request shall be filed for each one of the stations to be migrated from the Amplitude Modulation band to Frequency Modulation, based on Article 4 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada..

 

Frequency change requests filed prior to the effective date of the Guidelines are not substitutes of those referred in articles 3 4 of the Lineamientos mediante los cuales el Instituto Federal de Telecomunicaciones establece los criterios para el cambio de frecuencias de estaciones de Radiodifusión Sonora que operan en la banda de amplitud modulada a frecuencia modulada..
