Who?

Individual or legal entity (Sublessor) who has express consent from the Lessor, in the Lease Agreement, to fully or partially sublease the use, benefit and/or exploitation of one or more frequency bands subject matter of the Lease Agreement. 


When or in what cases?

When it is desired to fully or partially grant the right to use, benefit from and/or exploit one or more frequency bands subject matter of a Leasing Agreement in exchange of a certain price, to an individual or legal entity (Sublessee) holding a unique concession title for commercial or private use, with the purpose of private communications, or has requested it from the Federal Telecommunications Institute.

The Federal Telecommunications Institute will grant the interested party a non-extendable term of 15 business days to correct the corresponding omission or error.

 

In case that the petitioner does not reply to the warning within the term indicated in the preceding paragraph, the Federal Telecommunications Institute will reject the procedure, without prejudice to the filing of a new request.

Amount

The following duties shall be paid for the study of the request and, when applicable, authorization of the lease of concessioned frequency bands for commercial or private use, the latter for the purposes of private communications: $13,133.49 (thirteen thousand one hundred thirty-three pesos 49/100 MXN).

Article 22, section IV, of the Lineamientos Generales sobre la Autorización de Arrendamiento de Espectro Radioeléctrico.

Article 173-A, section IX, of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

The Federal Telecommunications Institute will verify that continuity in the services is not affected, economic efficiency on the use of the spectrum is promoted, and that no concentration or cross-ownership, anti-public interest situations, or hoarding is created, in terms of the Ley Federal de Telecomunicaciones y Radiodifusión and the Ley Federal de Competencia Económica.

 

The Sublessee may not in turn sublease the right to use, benefit from or exploit the Frequency Bands subject matter of the Subleasing Agreement.

 

To file the request, the electronic files shall perfectly match the printed copies. In case of differences, printed information shall prevail. In addition, the Federal Telecommunications Institute will decide according to the Instruction Manual on the subject of Economic Competition, Unique Addendum of the Lineamientos Generales sobre la Autorización de Arrendamiento de Espectro Radioeléctrico.

The Concessions and Services Unit will have a term of 5 business days following the notice of authorization to register it in the Public Concessions Registry.

Subleasing Agreements will be legally effective upon notice of the corresponding Authorization from the Federal Telecommunications Institute.
