Who?

Concessionaires of telecommunications and/or broadcasting services.


When or in what cases?

- When the assignee commits to comply with the obligations still pending and assumes the conditions that the Federal Telecommunications Institute establishes.

- When requested by the concessionaires and after a three year term from the granting of the concession.

- When the intention is to transfer the rights and obligations stipulated in the concessions to another concessionaire that provides similar services in the same geographic zone, the Federal Telecommunications Institute will previously analyze the actual or probable effects of such act on free competition and access to the corresponding market.

- When the holders of public or commercial use concessions intended for transfer to public entities, including public-private partnership arrangements, are the Powers of the Union, States, Government Agencies of the Federal District, Municipalities and constitutional autonomous agencies, with previous authorization by the Federal Telecommunications Institute.

Approval by the Institute is not required in those cases of transfer of Authorization by corporate merger, separation or restructuring, provided that such acts take place within the same controlling group or economic agent. The federal Telecommunications Institute shall be notified within 30 calendar days following the transaction.
