Who?

Individual or legal entity (Lessor) that holds a valid radio spectrum concession title for commercial use or a valid radio spectrum concession title for private use, for private communications purposes. 


When or in what cases?

When it is desired to fully or partially grant the right to use, benefit from and/or exploit, fully or partially, one or more frequency bands under a valid concession in exchange of a certain price, to an individual or legal entity (Lessee) holding a unique concession title for commercial or private use, with the purpose of private communications, or has requested it from the Federal Telecommunications Institute.

III. The information established in the Instructions Manual on the subject of Economic Competition.

The Federal Telecommunications Institute will grant the interested party a non-extendable term of 15 business days to correct the corresponding omission or error.

 

In case that the petitioner does not reply to the warning within the term indicated in the preceding paragraph, the Federal Telecommunications Institute will reject the procedure, without prejudice to the filing of a new request.

Amount

For the request study and, when applicable, the leasing approval of frequency bands for commercial or private use, in the case of the latter, with private communication purposes, rights must be paid according to the following fee: $13,752.00 (thirteen thousand seven hundred and fifty-two pesos 00/100 MXN).

Legal basis:

Article 173-A of the Ley Federal de Derechos, considering the expected update in the Modification to the Anexo 19  de la Resolución Miscelánea Fiscal para  2018, published in the Diario Oficial de la Federación en December 21, 2018.

- The Federal Telecommunications Institute will verify that continuity in the services is not affected, economic efficiency on the use of the spectrum is promoted, and that no concentration or cross-ownership, anti public interest situations, or hoarding is created.

- To file the request, the electronic files shall perfectly match the printed copies. In case of differences, the printed information shall prevail.  In addition, the Federal Telecommunications Institute will decide according to the Instruction Manual on the subject of Economic Competition, Unique Addendum of the Lineamientos Generales sobre la Autorización de Arrendamiento de Espectro Radioeléctrico.

- Leasing Agreements will be legally effective upon notice of the corresponding Authorization from the Federal Telecommunications Institute.
