The criteria that the Federal Institute of Telecommunications may apply for its resolution are:

1. Maintenance or replacement time schedule.

2. The specific causes to execute maintenance or replacement.

3. The length of time of suspension of transmissions of the broadcasting service.

4. That the notice was delivered at least 15 calendar days in advance to the date when it intends to suspend the service.

5. In case that no objection is stated within 5 business days from the indicated 15 business days term, the concessionaire may perform the maintenance or replacement, as the case may be, and

 

6. In case of extemporary delivery, the response is issued without prejudice of the capacities conferred upon the Compliance Unit by the Organic Statute of the Federal Telecommunications Institute relating to the supervision and verification of  applicable legal and administrative stipulations.
