Who?

In the case of lease, individual or legal entity (Lessor) that holds a valid radio spectrum concession title for commercial use or a valid radio spectrum concession title for private use, for private communications purposes.

In the case of sublease, individual or legal entity (Sublessor) who has express consent from the Lessor, in the Lease Agreement, to fully or partially sublease the use and/or exploitation of one or more frequency bands subject matter of the Lease Agreement. 


When or in what cases?

A lease or sublease agreement of radio spectrum will be subject of a new authorization in case an amendment in its clauses or addenda is intended.

9. Reference to the folios of the valid Radio Spectrum Concessions for the use and/or exploitation, as the case may be, of the frequency bands subject matter of the leasing contract.

10. Reference to the electronic folio of the valid unique concession title of the lessee or, when applicable, simple copy of the acknowledgment of the request for the corresponding unique concession, and

11. The information established in the Instructions Manual on the subject of Economic Competition.

 

Orfor the case of sublease:

9. Reference to the electronic folio of the unique concession title of the Sublessee.

10. Reference to the electronic folio of the valid unique concession title of the Sublessee or, when applicable, simple copy of the acknowledgment of the request for the corresponding unique concession.

11. The information established in the Instructions Manual on the subject of Economic Competition.

1. Notice to the lessor about the execution of the sublease agreement.

2. Duties and/or exploitations payment receipt for the subleasing authorization procedure.

3. Sublease agreement, and

4. The documentation established in the Instructions Manual on the subject of Economic Competition.

Business or natural days, months:

15 business days following the delivery of the request.

 

The Federal Telecommunications Institute will grant the interested party a non-extendable term of 15 business days to correct the corresponding omission or error.

 

In case that the petitioner does not reply to the warning within the term indicated in the preceding paragraph, the Federal Telecommunications Institute will reject the procedure, without prejudice to the filing of a new request.

Amount

The following duties shall be paid for the study of the request and, when applicable, authorization of the lease of concessioned frequency bands for commercial or private use, the latter for the purposes of private communications: $13,133.49 (thirteen thousand one hundred thirthy-one pesos 49/100 MXN).

Legal basis:

Article 173-A of the Ley Federal de Derechos, considering the update provided for in the Omnibus Tax Ruling for 2018 and its addendum 19, published in the Federal Official Gazette on December 22, 2017.

The Federal Telecommunications Institute will verify that continuity in the services is not affected, economic efficiency on the use of the spectrum is promoted, and that no concentration or cross-ownership, anti-public interest situations, or hoarding is created.

The Concessions and Services Unit will have a term of 5 business days following the notice of authorization to register it in the Public Concessions Registry.

In case of an amendment in the lease or price subject matter of the Lease Agreement of the Sublease Agreement of frequency bands of the radio spectrum, the lease or price agreed between the parties shall be informed to the Federal Telecommunications Institute at least 15 business days prior to the effective date of such amendment.
