Fourth and Eighth Transitory Articles of the "Decreto por el que se reforman y adicionan diversas disposiciones de los artículos 6o., 7o., 27, 28, 73, 78, 94 y 105 de la Constitución Política de los Estados Unidos Mexicanos, en materia de telecomunicaciones", published in the Diario Oficial de la Federación on June 11, 2013 (the “Decreto de Reforma Constitucional”)

Eighth, Tenth and Eleventh Transitory of the "Decreto por el que se expiden la Ley Federal de Telecomunicaciones y Radiodifusión, y la Ley del Sistema Público de Radiodifusión del Estado Mexicano; y se reforman, adicionan y derogan diversas disposiciones en materia de telecomunicaciones y radiodifusión” (el “Decreto de Ley”), which entered into effect on August 13, 2014.

Article 276 of the Ley Federal de Telecomunicaciones y Radiodifusión, published in the Diario Oficial de la Federación on July 14, 2014.

Articles 24, 25, 26, 27 and 28 of the Lineamientos generales para el otorgamiento de las concesiones a que se refiere el título cuarto de la Ley Federal de Telecomunicaciones y Radiodifusión, published in the Diario Oficial de la Federación, on July 24, 2015 , which were modified on May 26, 2017.

Who?

The holder of one or more concessions to install, operate and operate a public telecommunications network, granted under the Ley Federal de Telecomunicaciones that forms part of the prevailing economic agent in the telecommunications sector, in accordance with the provisions of article Eighth Transitory, fraction III of the Decreto de Reforma Constitucional.


When or in what cases?

When the concessionaires intend to transit or consolidate their public telecommunications network titles to a Single Concession for Commercial Use.

Through the IFT-Transition Format presented before the Filing Office of the Federal Telecommunications Institute

If the resolution is favorable, the Single Concession Certificate for Commercial Use will be issued, which will have a validity equal to the original one, counted from when the concession title of the public telecommunications network subject to the transition was granted, or , in case they are different titles, for the widest validity counted from the date of granting the title that has said validity.

Likewise, the Single Concession Certificate for Commercial Use shall establish as coverage commitments those localities, municipalities or states that have been established in the respective original concession titles.

In case the Federal Telecommunications Institute carries out any prevention to the interested party, the maximum period of resolution of the procedure or service will be suspended from the corresponding notification and will resume from the business day immediately following that in which the interested party answers.

Data:

 1. In the case of natural persons: name and, if applicable, commercial name, address in the national territory, email, telephone and registration key in the Federal Taxpayers Registry. 

2. In the case of legal entities: reason or company name and, if applicable, commercial name, address in the national territory (street, external number, internal number, locality or colony, municipality or delegation, federal entity and ZIP code), mail electronic, telephone and registration key in the Federal Taxpayers Registry.

3. If applicable, name of the legal representative, who has sufficient faculties to process the request.

4. The Electronic Folio of the concession that is intended to move to the Single Concession for Commercial Use. In the event of consolidation of several concessions, it will be enough to indicate an Electronic Folio of them.

Documents:

1. If the legal representative is not accredited before the Federal Telecommunications Institute, the testimony or certified copy of the instrument issued by public notary in which the powers of the legal representative must be attached to the IFT-Transition format.

2. Simple copy of the identification of the legal representative.

3. Proof of payment of the rights established in the Ley Federal de Derechos for the concept of transition to a single concession or the consolidation of one or more concessions to install, exploit and operate a public telecommunications network.

4. Certification of compliance in accordance with fraction III of the Tenth Transitory of the "Decreto por el que se expiden la Ley Federal de Telecomunicaciones y Radiodifusión, y la Ley del Sistema Público de Radiodifusión del Estado Mexicano; y se reforman, adicionan y derogan diversas disposiciones en materia de telecomunicaciones y radiodifusión”.

The deadline that the interested party has to attend to the prevention will be of 30 business days. If the prevention indicated in this period is not met, the Federal Telecommunications Institute will reject the procedure.

The deadline to address the prevention may be extended on a single occasion for an equal period, at the request of the interested party.

Amount

The applicant must pay for the study and, where appropriate, the approval of modifications in the technical characteristics the amount of $12,980.00 (twelve thousand nine hundred and eighty pesos 00/100 MXN.).

Legal basis:

Article 174-C, fraction XII, of the Ley Federal de Derechos, considering the updating provided in the Modification to Anexo 19 de la Resolución Miscelánea Fiscal para 2018, published in the Diario Oficial de la Federaciónon December 21, 2018.

The prevailing economic agents must be in compliance with:

(i) the obligations provided for in the respective concession titles and,

(ii) the obligations derived from the applicable legislation in the matter of telecommunications, broadcasting and economic competition.

(iii) the measures issued by the Federal Telecommunications Institute referred to in sections III and IV of the Eighth Transitory Article of the Decreto de Reforma Constitucional and

(iv)the measures referred to in fraction iii above, at least for eighteen months continuously.
