Lineamientos generales que establecen los requisitos, términos y condiciones que los actuales concesionarios de radiodifusión, telecomunicaciones y telefonía deberán cumplir para que se les autorice la prestación de servicios adicionales a los que son objeto de su concesión, published in the Diario Oficial de la Federación on May 28, 2014.

Who?

The holder of one or more concessions that have established any prohibition or express restriction to provide certain services.


When or in what cases?

When you wish to provide additional services to those that are the object of your concession.

Through the Application Form that is added as Anexo I to the Lineamientos generales que establecen los requisitos, términos y condiciones que los actuales concesionarios de radiodifusión, telecomunicaciones y telefonía deberán cumplir para que se les autorice la prestación de servicios adicionales a los que son objeto de su concesión, which must be presented before the Filing Office of the Federal Telecommunications Institute.


Legal basis:

Numeral II of the Lineamientos generales que establecen los requisitos, términos y condiciones que los actuales concesionarios de radiodifusión, telecomunicaciones y telefonía deberán cumplir para que se les autorice la prestación de servicios adicionales a los que son objeto de su concesión.

1. The Plenary of the Federal Telecommunications Institute will issue pronouncement on the origin or inadmissibility of the modification of the title of concession relative to the elimination of the restriction or prohibition for the provision of determined services and the consequent authorization for the provision of these.

2. Subsequently, in the event that the direction is appropriate, the Federal Telecommunications Institute will notify the interested concessionaire of the amount of the consideration that may be applicable, in order that the modification of the concession title, as well as the provision of the additional services requested.

3. Once the payment of the consideration referred to in the preceding paragraph has been accredited, the competent administrative unit of the Institute shall notify the interested concessionaire of the modification of the respective concession title and the authorization of corresponding additional services.

If the requirements for authorization have been met, the Federal Telecommunications Institute will register the modification of the respective concession title and the authorization of additional services in the Public Registry of Concessions.

60 calendar days after the submission of the respective request, the Federal Telecommunications Institute will issue a ruling on the appropriateness or inadmissibility of the modification of the concession title relative to the elimination of the restriction or prohibition for the provision of certain services and the consequent authorization for the provision of these.

 For those cases in which the resolution is in the sense of origin for the modification of the concession title in order to eliminate the restriction or express prohibition for the provision of certain services and the consequent authorization for the provision of these, the Federal Telecommunications Institute, within 45 calendar days after the notification of the provenance previously indicated, will notify the interested dealer, if applicable, the amount of the consideration whose payment will be condition for the granting of the respective authorization.

Data:

The concession holders of broadcasting, telecommunications or telephony services that seek to obtain authorization for the provision of services in addition to those authorized in their respective concession titles, must meet the following requirements:

 

1. Submit the requisite Application Form, which is added as Annex I to the Guidelines, signed by the concessionaire or legal representative duly accredited before this constitutional body, without alterations, deletions, amendments or changes.

2. Introduce the technical specifications of the additional service(s) that it intends to provide, including, where appropriate, the frequency band, the bandwidth or network capacity it will allocate for the provision of said service(s), as well as the geographical coverage in which it will provide the same, which shall not exceed the authorized coverage in the respective concession.

3. Provide detailed information about the services you intend to provide and your commercial offers.

Documents:

The concessionaires with express prohibition or restriction in their concession title for the provision of certain services, and who intend to obtain authorization to provide additional services to those contemplated in their respective concessions, in addition to observing the requirements described in section II of the Guidelines, they must include the following:

 

1. Deliver, simultaneously, the request expressed by the interested party in the sense that the respective concession is modified in order to eliminate said restriction or prohibition.

2. Exhibit the proof of payment of rights that is applicable with respect to the study of the request for modification of the concession title, in terms of the provisions of the Ley Federal de Derechos.

Business or natural days, months:

When the corresponding application does not contain the required data and / or information, within 20 calendar days following the application submission, the Institute will prevent the applicant, so that, within the non-extendable period of 5 business days counted from the day following the one in which the notification takes effect, he/she corrects the respective omission or defect.

When the applicant does not discuss the prevention carried out within the aforementioned period, the Federal Telecommunications Institute will reject the procedure, notwithstanding that interested parties may submit a new application

Amount

The concession holders with express prohibition or restriction in their concession title for the provision of certain services, and who seek to obtain authorization to provide additional services to those contemplated in their respective concessions, must make the payment of rights according to the following:

The applicant must pay for the study and, where appropriate, the authorization to provide an additional service for concessions that make use of the radio spectrum, the amount of $21,552.00 (twenty-one thousand five hundred fifty-two pesos 00/100 MXN).

The applicant must pay for the study and, where appropriate, the authorization to provide an additional service for concessions that do not use the radio spectrum, the amount of $7,880.00 (seven thousand eight hundred and eighty pesos 00/100 MXN.).

Likewise, and if applicable, the Federal Telecommunications Institute, within 45 calendar days after notification of the aforementioned origin, will notify the concessionaire concerned of the amount of the consideration, so that both the modification of the concession title and the provision of the additional services requested can be definitively authorized.

Article 174-C fractions IV and V of the Ley Federal de Derechos, considering the updating foreseen in the Modification to Anexo 19 de la Resolución Miscelánea Fiscal para 2018, published in the Diario Oficial de la Federación on December 21, 2018.

The Federal Telecommunications Institute will take into account that all the information and documentation referred to in statements 7.a and 7.b is duly integrated and complete.

That the concessionaire is in compliance with the obligations set forth in their respective concession titles and the obligations derived from the laws regarding telecommunications, radio broadcasting and economic competition.

The authorization issued by the Federal Telecommunications Institute in relation to requests for additional services will be without prejudice to the obligation to provide the services contemplated in the concession in question.
