Who?

The holder of one or more concessions to provide telecommunications services and that has been declared by the Federal Telecommunications Institute as part of the preponderant economic agent.


When or in what cases?

When you wish to provide additional services to those that are the object of your concession.

Through the Application Form that is added as Annex I to the General Guidelines that establish the requirements, terms and conditions that the current broadcasting, telecommunications and telephony concessionaires must fulfill in order to be authorized to provide additional services to those that are object of its concession, which must be presented before the Filing Office of the Federal Telecommunications Institute

Numeral II of the Lineamientos generales que establecen los requisitos, términos y condiciones que los actuales concesionarios de radiodifusión, telecomunicaciones y telefonía deberán cumplir para que se les autorice la prestación de servicios adicionales a los que son objeto de su concesión.

1. The Plenary of the Federal Telecommunications Institute will issue authorization to provide additional services in public telecommunications networks that do not operate frequency bands of the radio spectrum.

2. Now, if it is the case, the Plenary of the Federal Telecommunications Institute will issue a ruling on the admissibility or inadmissibility of the request for the provision of additional services to those originally contemplated in the concessions granted that make use of the radio spectrum.

3. Subsequently, in case that the sense was admissible, the Plenary of the Federal Telecommunications Institute will notify the interested concessionaire the amount of the consideration, whose payment will be condition for the granting of the respective authorization.

4. Once the payment of the aforementioned consideration has been accredited, the Plenary of the Federal Telecommunications Institute will issue a Resolution authorizing the provision of additional services to those originally contemplated in the granted concessions that make use of the radio spectrum.

If the requirements for authorization have been met, the Federal Telecommunications Institute will register said authorization to provide additional services in the concessions that make use of the radio spectrum in the Public Registry of Concessions.

Business or natural days, months:

60 natural days after the submission of the respective request, the Federal Telecommunications Institute will decide on the authorization of additional services to be provided on public telecommunications networks that do not operate frequency bands of the radio spectrum or, in the case of band concessions of frequencies of the radio spectrum, the Institute will issue pronouncement on the admissibility or inadmissibility of the application for additional services, considering its technical viability.

 For this last case, and if the Application for Additional Services is admissible, the Federal Telecommunications Institute, within 45 calendar days after notification of the admissibility indicated above, will notify the interested concession holder the amount of the consideration, whose payment it will be a condition for the granting of the corresponding authorization.

The concessions holders of broadcasting, telecommunications or telephony services that seek to obtain authorization for the provision of services in addition to those authorized in their respective concession titles, must meet the following requirements:

 

1. Submit appropriately filled out the Application Form, which is added as Annex I to the Guidelines, signed by the concessionaire or legal representative duly accredited before this constitutional body, without alterations, deletions, amendments or changes.

2. Present the technical specifications of the additional service(s) that he/she intends to provide, including, where appropriate, the frequency band, bandwidth or network capacity that it will allocate for the provision of mentioned service, as well as the geographical coverage in which it will provide the same, which shall not exceed the authorized coverage in the respective concession.

3. Include detailed information on the services you intend to provide and your commercial offers.

Documents:

In the case of the concessions holders, which have been declared as part of the interest groups that make up the preponderant agents of what is taken into account in Article Eighth Transitory, section III of the Decree, and that they intend to obtain the authorization to provide services additional to the contemplated in their corresponding concessions, and apart from complying with the requirements established in the Section II of the Guidelines, they must provide:

1. Proof of compliance with the measures that were imposed as part of the prevailing economic agent through the respective resolutions, for at least 18 (eighteen) months, counted from the notification thereof.

The concessionaires that are located in the provided hypothesis in the section "V. of the concessions with express prohibition or restriction to provide certain services" of the Guidelines, must also comply with the provisions of mentioned section. That is, they should:

1. Submit, simultaneously, the request expressed by the interested party in the sense that the respective concession is modified to eliminate said restriction or prohibition, and

2. Show the proof of rights payment that is applicable with respect to the study of the application for modification of the concession title, in terms of the provisions established in the Federal Law of Rights.

When the corresponding application does not contain the required data and / or information, within 20 calendar days following the submission of the application, the Institute will prevent the applicant, so that, within the non-extendable period of 5 business days counted from the day following the one in which the notification takes effect, corrects the respective omission or defect.

When the applicant does not present the prevention carried out within the aforementioned period, the Federal Telecommunications Institute will reject the procedure, notwithstanding that interested parties may submit a new application.

Amount

The concessionaires that have been declared as part of the interest groups that make up the preponderant economic agents, must make the rights payment according to the following:

The applicant must pay for the study and, if applicable, the authorization to provide an additional service for concessions that make use of the radio spectrum, the amount of $21,552.00 (twenty-one thousand five hundred and fifty-two 00/100 MXN).

The applicant must pay for the study and, where appropriate, the authorization to provide an additional service for concessions that do not use the radio spectrum, the amount of $7,880.00 (seven thousand eight hundred and eighty pesos 00/100 MXN).

Likewise, for the case in which the applications are related to concessions of frequency bands of the radio spectrum, the Federal Telecommunications Institute, within 45 calendar days after the notification of the admissibility indicated above, will notify the concerned concessionaire of the amount of the consideration, whose payment will be condition for the granting of the respective authorization.

Legal basis:

Article 174-C fractions IV and V of the Ley Federal de Derechos,  considering the updating foreseen in the Modification to Anexo 19 de la Resolución Miscelánea Fiscal para 2018, published in the Diario Oficial de la Federación on December 21, 2018.

Numerals III.2, V.3, of the Lineamientos generales que establecen los requisitos, términos y condiciones que los actuales concesionarios de radiodifusión, telecomunicaciones y telefonía deberán cumplir para que se les autorice la prestación de servicios adicionales a los que son objeto de su concesión.

The Federal Telecommunications Institute will take into consideration that all the information and documentation referred to in points 7.a and 7.b is duly integrated and complete.

That the concessionaire is in compliance with the obligations set forth in their respective concession titles and the obligations derived from the laws regarding telecommunications, radio broadcasting and economic competition.

The authorization issued by the Federal Telecommunications Institute in relation to requests for additional services will be without prejudice to the obligation to provide the services contemplated in the concession in question.
