Who?

Natural person and legal entity that has any of the following current titles:

Concession of radio spectrum for commercial usage.

Concession of radio spectrum for public usage.

Concession of radio spectrum for private usage

Concession of radio spectrum for social usage.

Concession of orbital resources for commercial usage.

Concession of orbital resources for public usage.

Concession of orbital resources for private usage.

Concession of orbital resources for social usage.


When or in what cases?

When the concessionaires wish to exchange between them a frequency, a set of them, a complete band or several frequency bands or orbital resources that have concessions.

Legal basis:

Article 106, fourth paragraph, of the Ley Federal de Telecomunicaciones y Radiodifusión.

Resolution of the Plenary of the Federal Telecommunications Institute in which it authorizes or denies the exchange of frequency bands or orbital resources. If the requirements for authorization have been met, the Federal Telecommunications Institute will register the authorization for the exchange of frequency bands or orbital resources in the Public Registry of Concessions

Data:

Free format letter for the exchange of frequency bands or orbital resources must contain the following:

1. To reference the electronic folios of the titles of Concession of Radio Spectrum or Concession of effective orbital resources, that cover the use and / or exploitation, as it corresponds, of the bands of frequencies or of orbital resources, object of the exchange;

 

2. Specify frequency bands or orbital resources, object of the exchange application referred to in article 106 of the Ley Federal de Telecomunicaciones y Radiodifusión;

 

3. Specify the authorized service and the coverage assigned to the frequency bands or orbital resources, object of the request for change referred to in article 106 of the Ley Federal de Telecomunicaciones y Radiodifusión

4. Address to receive notifications;

 

5. Name and email of the person or persons authorized to receive notifications, and

 

6. Signature of the interested party or his representative.

When the corresponding application does not contain the required data and / or information, within the first third of the response period, the Federal Telecommunications Institute will prevent the applicant, so that, within the non-extendable period of 10 business days as of the day after the one in which the notification takes effect, he/she corrects the respective omission or defect.

When the applicant does not present the prevention carried out within the aforementioned period, the Federal Telecommunications Institute will reject the procedure, notwithstanding that interested parties may submit a new application.

 The applicant must pay for the study and, where appropriate, approval of modifications in the technical characteristics the amount of $ 13,785.00 (Thirteen thousand seven hundred and eight-five pesos 00/100 MXN).

The Federal Telecommunications Institute will take in consideration that all the information referred to in the section "Information that must be provided to complete the procedure" is complete.

 The Federal Telecommunications Institute will verify that the requested exchange does not cause alteration to the planning, does not affect the competition and free competition or to third parties, does not generate phenomena of concentration, hoarding or any phenomenon contrary to the competition process and an efficient use of the spectrum or orbital resources.
