Who?

Natural person or legal entity that has any of the following valid titles:

Radio spectrum concession for commercial use.

Radio spectrum concession for public use.

Radio spectrum concession for private use.

Radio spectrum concession for social use.

Orbital resources concession for commercial use.

Orbital resources concession for public use.

Orbital resources concession for private use.

Orbital resources concession for social use.


When or in what cases?

When it is desired to change one or more frequency bands subject to a current radio spectrum concession, or orbital resources object of an existing orbital resource concession.

Resolution of the Plenary of the Federal Telecommunications Institute in which it authorizes or denies the change of frequency bands or orbital resources. If the requirements for authorization have been met, the Federal Telecommunications Institute will register the authorization to change frequency bands or orbital resources in the Public Registry of Concessions

Free written application for change of frequency bands or orbital resources containing the following:

 

1. Reference the current Radio Spectrum Concession or Orbital Resources Concession title(s) folio(s), that cover the use, and / or exploitation, as it corresponds, of the frequency bands or orbital resources, object of the change;

 2. Specify frequency bands or orbital resources, object of the application for change referred to in article 106 of the Federal Telecommunications and Broadcasting Law;

3. Specify the authorized service and the coverage assigned to the frequency bands or orbital resources, object of the application for change referred to in article 106 of the Federal Telecommunications and Broadcasting Law;

4. Address to receive notifications;

5. Name and email of the person or persons authorized to receive notifications, and

6. Signature of the interested party or his legal representative.

When the corresponding request does not contain the required data and / or information, within 30 business days of the request submittal, the Federal Telecommunications Institute will prevent the applicant, so that, within the Not-extendable period of 10 business days counted as of the day following the date on which the notice becomes effective, he/she corrects the respective omission or defect.

 

When the applicant does not discuss the prevention carried out within the aforementioned period, the Federal Telecommunications Institute will reject the procedure, notwithstanding that interested parties may submit a new application.
