Who?

Natural persons and legal entities holding concessions of public telecommunications networks whose concession titles do not consider presenting notices to provide additional services.


When or in what cases?

When the concession holders of public telecommunications networks wish to provide additional services to those previously authorized.

Through the Application Form that is added as Annex I to the General Guidelines that establish the requirements, terms and conditions that the current broadcasting, telecommunications and telephony concessionaires must fulfill in order to be authorized to provide additional services to those that are object of its concession, presented before the Filing Office  of the Federal Telecommunications Institute.

Letter issued by the Concessions and Services Unit Holder in which he authorizes or denies the provision of additional services.

If the requirements for authorization have been met, the Federal Telecommunications Institute will register said authorization to provide additional services in the Public Registry of Concessions.

Articles 32 and 33, fraction VIII of the Estatuto Orgánico del Instituto Federal de Telecomunicaciones.

The broadcasting concession holders, telecommunications or telephony services that seek to obtain authorization for the provision of services in addition to those authorized in their respective concession titles, must meet the following requirements:

1. Deliver the requisite Application Form, which is added as Annex I to the Guidelines, signed by the concessionaire or legal representative duly accredited before this constitutional body, without alterations, deletions, amendments or changes.

2. Deliver the technical specifications of the additional service that it intends to provide, including, where appropriate, the frequency band, the bandwidth or network capacity it will allocate for the provision of mentioned service, as well as the geographical coverage in which it will provide, which shall not exceed the authorized coverage in the respective concession.

1. If the legal representative is not accredited before the Federal Telecommunications Institute, it must attach the testimony format or certified copy of the instrument issued by a public notary stating the faculties of the legal representative, as well as a simple copy of the representative's legal identification.

2. Exhibit the proof of applicable rights payment with respect to the study and, where appropriate, the authorization of the application for modification of the concession title, in terms of the provisions of the Ley Federal de Derechos.

Within 20 calendar days following the submission of the application.

It is important to note that the prevention to the applicant will be for a non-extendable period of 5 working days, as of the day in which the corresponding notification has taken effect. Once said period has elapsed without the respective prevention being resolved, the procedure shall be rejected, leaving the right of the interested party to present a new Application for Additional Services.

Amount

The applicant must pay for the study and, if applicable, the authorization to provide an additional service of the concessions that do not use the radio spectrum, the amount of $7,880.00 (seven thousand eight hundred and eighty pesos 00/100 MXN).

Legal basis:

Article 174-C fraction V of the Ley Federal de Derechos, considering the update provided for in the Modification to Anexo 19 de la Resolución Miscelánea Fiscal para 2018, published in the Diario Oficial de la Federación on December 21, 2018.

The Federal Telecommunications Institute will take into account that all the information required in the corresponding format is duly integrated and complete. Likewise, it will take into consideration the following:

1. Submit the requisite Application Form, which is added as Annex I to the Guidelines, signed by the concessionaire or legal representative duly accredited before this constitutional body, without alterations, deletions, amendments or changes.

2. Submit the technical specifications of the additional service (s) it intends to provide, as well as the geographical coverage in which it will provide the same.

3. To be in compliance with the obligations (i) set forth in their respective concession titles, and (ii) the obligations derived from the laws regarding telecommunications, radio broadcasting and economic competition.

The authorization issued by the Federal Telecommunications Institute in relation to requests for additional services will be without prejudice to the obligation of providing the services contemplated in the concession in question.
