Who?

Licensees, concessionaires and/or assignees of telecommunications and broadcasting services.


When or in what cases?

Payment shall be made from January to March of the corresponding year. From the month of April, it will be deemed as untimely payment.

 1. Through the Internet in the consideration system, or

 2. In written form, in free format submitted at the facilities of the Federal Telecommunications Institute

4. Network structure modification documents (when applicable)

5. Change of name or corporate name document (when applicable), and

6. Permission cancellation official document (when applicable).

The following are exempt of payment of this fee:

1. Radio and television corporations bound to withhold the tax for services expressly determined as public interest by Law, involving concessionaire corporations of goods under direct control of the nation.

2. Those concessionaires or licensees or other telecommunications services users who have contracted the operation of frequencies or bands of frequencies with concessionaires who have obtained frequencies or bands of frequencies by public tender and are authorized to provide the capacity to establish point-to-point or point-to-multipoint microwave links, or to provide wireless access, fixed or mobile, services, as well as to provide restricted television or radio services, or other services.

3. Medical assistance institutions, charities, prevention or assistance in case of accidents or disaster institutions, who are not subject to income tax, and users of frequencies authorized during the visits of heads of state and foreign diplomatic missions of the country, whose authorizations are filed by the embassies in the country or the Ministry of Foreign Affairs, provided that they accredit such circumstances.

4. Official use bands granted to the States and Municipalities, dedicated to prevention and assistance in case of accidents and disaster, public security, national security, health, social security, protection of the environment, and education.

Amount

The rates shall be paid annually for each frequency assigned to the subject (licensees, concessionaires and/or assignees of telecommunications and broadcasting services) for the use of radio spectrum frequencies.

Article 240.- The duties for the use of the radio spectrum, by private radio communication systems, will be paid annually for each assigned frequency, in accordance to the following rates:

 

I. For networks that possess base or relay stations:

a) For each base station .......................................................................................... $9,187.00

II.- For those who only have mobile or portable equipment in the network, it will be paid for all mobile and portable equipment, or private radio communications user terminals.................................................... $6,044.08

VIII. For systems using the radio spectrum for testing purposes, with temporary authorizations with a maximum validity of 2 years, duties will be paid for the use of the radio spectrum in the following terms:

a) For systems operating for terms up to six months ..............................$2,952.91

b) For systems operating for terms of more than six months ..........................$5,505.91

IX.- For private mobile specialized fleet radio communications services (trunking), payment will be made for each frequency regardless of the number of bases, mobiles and relays....................................................................$12,093.32

Article 241.- Concessionaires of emission and reception of signals and frequency bands associated to foreign satellite systems that cover and may provide service in the National Territory, who provide satellite capacity services, will pay for the use, enjoyment or exploitation of the radio spectrum in the stretch within the National Territory, for each day of use, in accordance with the following rates:

I.- For each megahertz used in the national territory to provide C band telecommunications services .........$97.73

II.- For each megahertz used in the national territory to provide Ku band telecommunications services .........$149.54

In case the concessionaire uses radio spectrum frequency bands during some portions of the day, it shall pay the rates established in sections I and II above in the corresponding proportion.

Payment of the duties referred in this article shall be made in accordance to the following:

The amount corresponding to the megahertz used during the term from January to June of the corresponding fiscal year shall be paid on July 17 at the latest; and the amount corresponding to the megahertz used during the term from July to December of the previous fiscal year, on January 17 at the latest.

To calculate the payment of duties referred in this article, the mandatory number of megahertz that the concessionaire shall contribute to the Ministry of Communications and Transport, according to its Concession Title, will be subtracted from the total of used megahertz. 

The annual amount of the duty to be paid may not be higher than the result obtained from subtracting the net annual amount paid to the authorities of country of origin of the foreign satellite system from the amount obtained in accordance with sections I and II above, for the concession of each orbital position used to provide services in the National Territory.

Concessionaires enabled to perform this operation shall provide irrefutable proof to the Federal Telecommunications Institute of the payments made to the competent authority in the country of origin of the foreign satellite system, for the concession of each orbital position.

In case the payment made in the country of origin of the foreign satellite system covers more than one annual term, the Federal Telecommunications Institute will indicate the concessionaires, as an administrative aid, the equivalent annual payment in Mexican currency, corresponding to the present value of the total paid amount, using an effective annual discount rate of 2.50 per cent, considering the term covered by such payment and the number of megahertz associated to each orbital position of the foreign satellites assigned to provide services in the National Territory.

Also, the annual amount paid to the authorities of the country of origin of the foreign satellite system, for the concession of each orbital position, shall be multiplied by the exchange rate published by the Bank of Mexico in the Official Gazette on the its payment date and will be further updated in the terms of article 17-A of the Federal Tax Code.

To the effects of this article, payments made to the authorities of the country of origin of the foreign satellite system for the use of frequency bands may not be credited. The credit referred in this article does not cause any reimbursement or compensation.

Article 242.- Concessionaires who use and exploit geostationary and satellite orbital positions assigned to the country, with their corresponding frequency bands with rights of emission and reception of signals, who provide satellite capacity services, will pay for the use, enjoyment or exploitation of the radio spectrum in the stretch within the National Territory, for each day of use, in accordance with the following rates:

I.- For each megahertz used in the national territory to provide C band telecommunications services .........$97.73

II.- For each megahertz used in the national territory to provide Ku band telecommunications services .........$149.54

Article 242-A.- (Repealed)

Article 242-B.- The right to use the radio spectrum, by radio links between studio-plant and from remote mobile stations, related to transmission, reception and relay equipment, will be paid annually in accordance to the following rates:

I.- For each frequency used by a transmission, reception or relay station for studio-plant and remote mobile stations links of broadcasting stations in A.M. and F.M...............$7,046.31

II.- For each frequency used by a transmission, reception or relay station for studio-plant and remote mobile stations links of broadcast television stations...............$14,093.11

III. For each frequency used for public land radio communications network links to provide public pay radio services with digitalized signal or continuous music systems ........$7,255.93

IV. For each frequency used for public land radio communications network links to provide public pay television services, cable television systems or high definition television........$14,511.98

In case of reutilization of the frequencies referred above, the duties will be paid in accordance with the rate corresponding to the section.

For concessions and permits with a smaller coverage area than the region in which they are located according to table B, the duties rate to be paid will be the result of multiplying the corresponding rate for the region in which the concession or permit is located, according to the table, by the percentage of the total population of such region represented by the total population of the area covered by the concession or permit. For these calculations, the population indicated in the final results of the Population and Housing count for the previous year published by the National Statistics and Geography Institute shall be exclusively used, or, in their absence, the final results from the most recent General Population and Housing Census published by said Institute.

In case that the coverage area of a concession or permit covers more than one region among those in table B, the calculations described above shall be performed for each region, when applicable, and the amount to pay for the duties will be the sum of the corresponding rates.

Payment of the duties stipulated in this article shall be made without prejudice of the compliance with the fiscal obligations included in the corresponding concession titles, as well as the concessions referred in the Ley Federal de Telecomunicaciones y Radiodifusión, applicable for the granting, renewal or extension of the concession titles, or the authorization of additional services.

Article 244-A. Concessionaires and licensees of radio spectrum frequencies included in the megahertz ranges indicated in table A shall pay annually the duties for the use, enjoyment and exploitation of the frequency bands of the radio spectrum, for each region and for each assigned kilohertz, in accordance to table B, as follows:

For concessions and permits with a smaller coverage area than the region in which they are located according to table B, the duties rate to be paid will be the result of multiplying the corresponding rate for the region in which the concession or permit is located, according to the table, by the percentage of the total population of such region represented by the total population of the area covered by the concession or permit. For these calculations, the population indicated in the final results of the previous year’s Population and Housing surveys published by the National Institute of Statistics and Geography, or from the most recent General Population and Housing Census published by said Institute, shall be used.

Duties payment referred by this article will be made without prejudice of the stipulations of article 14 of the Ley Federal de Telecomunicaciones.

Article 244-C.- Concessionaires and licensees of radio spectrum frequencies included in the megahertz ranges indicated in table A shall pay annually the duties for the use, enjoyment and exploitation of the frequency bands of the radio spectrum, for each region and for each assigned kilohertz, in accordance to table B, as follows:

For these calculations, the population indicated in the final results of the previous year’s Population and Housing surveys published by the National Institute of Statistics and Geography, or from the most recent General Population and Housing Census published by said Institute, shall be used.

In case that the coverage area of a concession or permit covers more than one region among those in table B, the calculations described above shall be performed for each region, when applicable, and the amount to pay for the duties will be the sum of the corresponding rates.

Duties payment referred by this article will be made without prejudice of the stipulations of article 14 of the Ley Federal de Telecomunicaciones y Radiodifusión.

Article 244-D.- Concessionaires and licensees of radio spectrum frequencies included in the megahertz ranges indicated in table A shall pay annually the duties for the use, enjoyment and exploitation of the frequency bands of the radio spectrum, for each region and for each assigned kilohertz, in accordance to table B, as follows:

 For concessions and permits with a smaller coverage area than the region in which they are located according to table B of article 244-E of the Ley Federal de Derechos, the duties rate to be paid will be the result of multiplying the corresponding rate for the region in which the concession or permit is located, according to the table, by the percentage of the total population of such region represented by the total population of the area covered by the concession or permit. For these calculations, the population indicated in the final results of the Population and Housing count for the previous year published by the National Statistics and Geography Institute shall be exclusively used, or, in their absence, the final results from the most recent General Population and Housing Census published by said Institute.

Payment of the duties stipulated in this article shall be made without prejudice of the compliance with the fiscal obligations included in the corresponding concession titles, as well as the concessions referred in the Ley Federal de Telecomunicaciones y Radiodifusión, applicable for the granting, renewal or extension of the concession titles, or the authorization of additional services.

Article 244-F. II.- In each radio frequency channel for each group of 120 telephone channels or fraction, and up to 960 telephone channels or equivalent capacity for any other type of telecommunications signals ....................................................................................$6,159.20

The total rate for each link will be the result of the cumulative application of the rates corresponding to sections I, II and III

Article 245-A.- (Repealed)

Article 245-B.- The duties for the use of the radio spectrum, for point-to-point and point-to-multipoint systems between stations, with or without relay, will be paid annually in accordance to the following rates:

I.- For rural community telephony:
